Conditional Use Permit Criteria – Section 1355.04, Subd.3 <br /> <br />Section 1355.04, Subd. 3 of the Arden Hills Zoning Code lists the criteria for evaluating a <br />Conditional Use Permit. The Planning Commission and City Council should consider the effect <br />of the proposed use upon the health, safety, convenience and general welfare of the owners and <br />occupants of the surrounding land, in particular, and the community as a whole, in general, <br />including but not limited to the following factors: <br /> <br />1. Existing and anticipated traffic and parking conditions; <br />2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, <br />and other nuisance characteristics; <br />3. Drainage; <br />4. Population density; <br />5. Visual and land use compatibility with uses and structures on surrounding land; <br />adjoining land values; <br />6. Park dedications where applicable; and the <br />7. Orderly development of the neighborhood and the City within the general purpose <br />and intent of this ordinance and the Comprehensive Development Plan for the City. <br /> <br /> <br />3. Variance Requirements – Section 1355.04, Subd. 4 <br /> <br />The applicant has requested a variance in order to allow the proposed addition to the Academics <br />Common building to encroach into the structure setback requirement from Valentine Lake. The <br />lake is classified as a Natural Environmental Lake and the required structure setback is 150 feet <br />from the ordinary high water level. At its closest point, the proposed addition would be 118 feet <br />from the ordinary high water level for an encroachment of 32 feet into the required setback. This <br />addition is not proposed to be constructed at this time, and if the variance is approved the setback <br />distance would be verified at the time a Site Plan review application is submitted. <br /> <br />Valentine Lake is classified as a Natural Environmental Lake by the Minnesota Department of <br />Natural Resources (DNR). Natural Environmental is the strictest of the three lake classifications <br />used by the DNR. Generally, Natural Environmental lakes are less developed than General <br />Development and Recreational Development lakes, but the classification is mainly used by the <br />DNR to determine lot size and setbacks. In the case of Natural Environmental lakes, the <br />minimum lot size and structure setbacks from the ordinary highwater line are greater than the <br />other lake classifications. For example, the minimum structure setback for General Development <br />lakes is 50 feet and for Recreational Development lakes 75 feet. The purpose of the stricter <br />regulations for Natural Environmental lakes is to preserve the natural quality of the lakes and <br />minimize density and development. <br /> <br />The Planning Commission and City Council must use the following criteria when reviewing a <br />request for a Variance:
