The spirit and intent of the Ordinance is about prohibiting building too close to <br />the lake. The proposed addition is still 118’ away from the high water mark. <br />4. The variance will not create a land use not permitted in the zone; <br />a. Correct. The only land use allowed in the Institutional Zone is Higher Education, <br />Campus. This variance request has no effect on land use definitions nor zone <br />boundaries. <br />5. The variance will not alter the essential character of the City; <br />a. Correct, this variance will not alter the essential character of the City. Further, it will not <br />negatively alter the essential character of Bethel University. It would promote and <br />encourage the character of the University. <br />6. The variance is not for economic reasons alone; <br />a. Correct, this request for variance is not for economic reasons only.
