Page 1 of 2 <br /> <br />PUBLIC HEARING – 8B <br /> <br />MEMORANDUM <br /> DATE: November 13, 2018 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> <br />FROM: Julie Hanson, City Clerk <br /> <br />SUBJECT: Public Hearing – Public Comment, Tobacco Ordinance <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> $ $ $ <br /> Council Should Consider <br />Accepting further public comment regarding increasing the tobacco sales age to 21 and/or regulating <br />the sale of flavored and/or menthol tobacco. <br /> <br />Background/Discussion <br />At its work sessions in August and October, the Council discussed possibly amending City Code <br />pertaining to increasing the tobacco sales age to 21 and/or regulating the sale of flavored and/or <br />menthol tobacco in the city. Kristen Ackert from the Association for Non-Smokers MN was in <br />attendance at the August work session and the Council accepted public comment from tobacco vendors <br />that were in attendance at the October work session. <br />The Council made the decision to receive further public comment at the November 13 public hearing <br />before making a final decision regarding any potential ordinance amendment. The Council could meet <br />at a future work session should it wish to move forward with any ordinance amendment. <br />The following provides an update as to where many other cities are currently at (red denotes nearby <br />city): <br />Cities that regulate sales of flavored tobacco products: <br />• Falcon Heights (including menthol, mint and wintergreen) *Went into effect 7/1/18 <br />• Lauderdale (including menthol, mint and wintergreen) *Goes into effect 2/1/19 <br />• Mendota Heights (not menthol, mint, wintergreen) *Voting on T21/updating flavor ordinance <br />to include these flavors on 11/20/18) <br />• Minneapolis (including menthol, mint and wintergreen) *Went into effect on 8/1/18 <br />• Robbinsdale (not menthol, mint and wintergreen) * Went into effect 4/1/18 – they are holding a <br />meeting in mid-November to discuss adding menthol, mint and wintergreen restrictions <br />• Shoreview (not menthol, mint and wintergreen) <br />• St. Louis Park (not menthol, mint and wintergreen) <br />• St. Paul (including menthol, mint and wintergreen) *Went into effect 11/1/18
