Page 1 of 1 <br /> <br />CONSENT ITEM – 7F <br /> <br />MEMORANDUM <br /> <br />DATE: January 14, 2019 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> <br />FROM: Sue Polka, Public Works Director/City Engineer <br /> <br />SUBJECT: Authorizing the State of Minnesota Public Works Mutual Aid Pact <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> N/A $0 N/A <br /> <br /> <br />Council Should Consider <br />Adopt Resolution 2019-003 (Attachment A) approving the State of Minnesota Public Works <br />Mutual Aid Pact and authorize the Mayor to execute the Agreement. <br /> <br />Background/Discussion <br />The purpose of this agreement is to provide a process for local units of government to share <br />public works personnel and equipment with participating agencies. There is no membership or <br />fixed cost to participate in this Public Works Mutual Aid Pact (Attachment B). <br /> <br />This agreement should not be interpreted as being limited to only use during catastrophic <br />situations, rather may be leveraged for routine circumstances such as training efforts and <br />maintenance operations. The decision as to when to request assistance or provide assistance is <br />left entirely to the discretion of the requesting and or sending party. The sending party has <br />discretion as to whether to provide personnel or equipment and can recall such assistance at any <br />time. <br /> <br />If resources are requested, it should be expected that those costs would be invoiced. However, <br />the agreement states that “charges may be levied”, so it is the decision of the sending party as t <br />whether or not to invoice the receiving party. The agreement also speaks to responsibility and <br />liability. Each party shall be responsible for its own personnel or damaged equipment for <br />example. Responding personnel shall be deemed to be performing regular duties for each <br />respective sending party for purposes of workers compensation.
