ARDEN HILLS CITY COUNCIL – MARCH 25, 2019 10 <br /> <br />may impact some of the City’s businesses. He anticipated that the playing field would be leveled <br />once the State took action on this matter. In addition, he believed that by passing this Ordinance a <br />message would be sent to the local and State legislators. <br /> <br />Councilmember Holden commented she also supported changing the tobacco sales age to 21. <br /> <br />Councilmember Scott thanked the young people who came out to speak tonight. He appreciated <br />the fact that they came out to speak regarding this issue. He noted he met with the City’s State <br />Rep and explained there was movement in the legislature to take statewide action. He reported <br />there was support in the House but not the Senate. He indicated this may change. He commented <br />on how he was raising his children in a first-generation smoke-free environment. He discussed <br />the importance of not allowing young adults to be exposed to tobacco products at an early age. He <br />explained he would be proposing an amendment to the Ordinance and suggested the Ordinance <br />not take effect until a later date. He stated if the Ordinance were to take effect on Tuesday, March <br />26, 2019, this would put an undo burden on local business owners. <br /> <br />City Clerk Hanson reported vendors would be given until July 1 , 2019, to comply with the new <br />Ordinance. <br /> <br />Councilmember Scott stated he would be supporting the Ordinance as presented. <br /> <br />MOTION: Councilmember McClung moved and Councilmember Holden seconded a <br />motion to adopt Ordinance #2019-003 Amending Chapter 3, License and <br />Regulations, Section 350, Tobacco Products removing the blue font language <br />in Subdivision 11 on Page 6 regarding samples, and authorizing summary <br />publication of the Ordinance. <br /> <br />Councilmember Holmes requested an amendment to the Ordinance on Page 8, stating she would <br />like to see adult tobacco shops allowed to sell flavored products. She recommended all of the <br />crossed-out language in Subdivision 2 not be crossed out. She supported this amendment because <br />only individuals over the age of 21 could enter an adult tobacco shop. She explained the intent of <br />this Ordinance was to protect those under the age of 21 and this amendment would still be in <br />alignment this this intent. <br /> <br />AMENDMENT: Councilmember Holmes moved to amend the Ordinance Amending <br />Subdivision 2 to allow for the sale of flavored tobacco in adult tobacco <br />shops. The amendment failed for lack of a second. <br /> <br />Councilmember Holden commented if the purpose was to stop young people from smoking, she <br />had a different view on flavored tobacco than if the purpose was to assist adult smokers from <br />smoking. <br /> <br />Councilmember McClung indicated he supported the Ordinance as drafted which would prohibit <br />the sale of flavored products in Arden Hills. <br /> <br />Mayor Grant stated he would support the language as written. <br />
