The relocation of the building requires the Applicant to utilize
existing City park property. As noted above, the proposal involves an exchange of 0.37 acres of
parkland for 0.03 acres of the Applicant’s property, along with the construction of a trail and
other recreational amenities onsite.
According to Minnesota Statutes 462.356, subdivision 2, the City must make a determination
that the sale of the land is in conformance with the adopted Comprehensive Plan. Specifically,
the State Statute reads:
“No publicly owned interest in real property within the municipality shall be acquired or
disposed of, nor shall any capital improvement be authorized by the municipality or special
district or agency thereof or any other political subdivision having jurisdiction within the
municipality until after the planning agency has reviewed the proposed acquisition, disposal, or
capital improvement and reported in writing to the governing body or other special district or
agency or political subdivision concerned, its findings as to compliance of the proposed
acquisition, disposal or improvement with the comprehensive municipal plan.”
Section 220.03, Subd. 2, of the City Code designates the Planning Commission as City’s
Planning Agency. As such, the Planning Commission is tasked with determining whether the
proposed land exchange is consistent with the Comprehensive Plan.
In addition, Section 720.09 of the City Code requires any “proposal to divert recreational areas
to other uses or to dispose of recreational areas shall be forwarded to the City's park and
recreation committee for review and recommendations.” This request will be forwarded to the
Park and Recreation Committee before the City Council meeting.
