<br />_____________________________________________________________________________________________ <br />City of Arden Hills <br />PTRC Meeting for July 18, 2019 <br />P:\Planning\Planning Cases\2019\19-002 - Summit Development - PUD, CPA, RZ, PP, FP <br /> <br />Page 4 of 4 <br />Planning Commission Recommendation <br />According to Minnesota Statutes 462.356, subdivision 2, the City must make a determination that <br />the sale of the land is in conformance with the adopted Comprehensive Plan. Specifically, the <br />State Statute reads: <br /> <br />“No publicly owned interest in real property within the municipality shall be acquired or disposed <br />of, nor shall any capital improvement be authorized by the municipality or special district or <br />agency thereof or any other political subdivision having jurisdiction within the municipality until <br />after the planning agency has reviewed the proposed acquisition, disposal, or capital improvement <br />and reported in writing to the governing body or other special district or agency or political <br />subdivision concerned, its findings as to compliance of the proposed acquisition, disposal or <br />improvement with the comprehensive municipal plan.” <br /> <br />Section 220.03, Subd. 2, of the City Code designates the Planning Commission as City’s Planning <br />Agency. As such, the Planning Commission is tasked with determining whether the proposed land <br />exchange is consistent with the Comprehensive Plan. <br /> <br />The Planning Commission considered this application at their July 10, 2019 meeting. At that time <br />the application was approved by a 6-0 vote. The Planning Commission supported the proposed <br />land exchange and the proposed park improvements. A condition of approval for the project <br />requires the applicant to maintain all of proposed sidewalks, trails and exercise equipment until a <br />written agreement between the City and owner establishes a different requirement. This will also <br />be memorialize in the operations and maintenance agreement between the city and the developer. <br /> <br />Parks, Trails and Recreation Committee Role <br />Section 720.09 of the City Code requires any “proposal to divert recreational areas to other uses <br />or to dispose of recreational areas shall be forwarded to the City's park and recreation committee <br />for review and recommendations.” The PTRC should make a recommendation to the City Council <br />to approve or deny the requested land exchange. <br /> <br />Attachments <br />A.
