The relocation of the building requires the Applicant to utilize existing <br />City park property. As noted above, the proposal involves an exchange of 0.37 acres of parkland <br />for 0.03 acres of the Applicant’s property, along with the construction of a trail and other <br />recreational amenities onsite. <br /> <br />According to Minnesota Statutes 462.356, subdivision 2, the City must make a determination that <br />the sale of the land is in conformance with the adopted Comprehensive Plan. Specifically, the <br />State Statute reads: <br /> <br />“No publicly owned interest in real property within the municipality shall be acquired or disposed <br />of, nor shall any capital improvement be authorized by the municipality or special district or <br />agency thereof or any other political subdivision having jurisdiction within the municipality until <br />after the planning agency has reviewed the proposed acquisition, disposal, or capital improvement <br />and reported in writing to the governing body or other special district or agency or political <br />subdivision concerned, its findings as to compliance of the proposed acquisition, disposal or <br />improvement with the comprehensive municipal plan.” <br /> <br />Section 220.03, Subd. 2, of the City Code designates the Planning Commission as City’s Planning <br />Agency. As such, the Planning Commission is tasked with determining whether the proposed land <br />exchange is consistent with the Comprehensive Plan. <br /> <br />In addition, Section 720.09 of the City Code requires any “proposal to divert recreational areas <br />to other uses or to dispose of recreational areas shall be forwarded to the City's park and <br />recreation committee for review and recommendations.” This request will be forwarded to the <br />Park and Recreation Committee before the City Council meeting. <br /> <br />
