C. Pursuant paragraph 33.E. of the Development Contract, any requested amendments shall be <br /> approved by the City subject to the requirements of the Arden Hills City Code and Ordinances. <br /> D. Pursuant to paragraph 28.A. of the Development Contract, the Developer has requested an <br /> amendment to the Development Contract to implement the Lake Valentine Pedestrian Study, and as <br /> amended by the supplemental agreements, which includes safety improvements on Lake Valentine Road to <br /> address traffic and increased pedestrian crossings between the school building and the north parking lot, <br /> including installation of turn lanes and other access improvements, trail and sidewalk improvements, <br /> pedestrian signal, signage and striping modifications, and drainage and utility improvements <br /> ("Improvements"). <br /> E. Pursuant to City Code, Chapter 13, Section 1255.04, a PUD Amendment may be approved <br /> by a simple majority of the City Council after public hearing and recommendation of the Planning <br /> Commission. The Developer shall follow the procedures and requirements of the Development Contract. <br /> This PUD Amendment shall be executed by the City and Developer/Owner, and recorded against the <br /> Subject Property. <br /> F. The City Council reviewed and approved the proposed PUD Amendment on April 27, <br /> 2020, subject to the conditions in Exhibit"B" attached hereto. All conditions of approval set forth in <br /> Exhibit`B" are hereinafter the obligations of the Developer. <br /> NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br /> 1. The City approves the Developer's request for a PUD Amendment to the Development <br /> Contract subject to the implementation of the recommendations and subject to the conditions listed on <br /> Exhibit"B". <br /> 2. The Developer shall construct and install all required Improvements pursuant to the City <br /> approved plans and specifications for Lake Valentine Road Improvements prepared by Bolton & Menk <br /> 2 <br /> 211093v2 <br />
