The final concrete curb, sidewalk, curb ramps, pavement markings, and pavement work <br /> shall be installed before November 17, 2020. The signal system shall be installed and fully functional <br /> before February 15, 2021. The Developer may, however, request an extension of time from the City. If <br /> an extension is granted, it shall be conditioned upon updating the security posted by the Developer to <br /> reflect cost increases and the extended completion date. Final wear course placement must have the <br /> written approval of the City Engineer, and may be delayed or scheduled at any time of the year based <br /> upon existing site conditions at the discretion of the City Engineer. <br /> 4. The Developer warrants all Improvements required to be constructed by it pursuant to this <br /> Agreement for a period of twenty-four(24) months from the date of acceptance by the City against poor <br /> material and faulty workmanship. <br /> 5. The Developer shall pay all costs incurred pursuant to the Engineer's Opinion of Probable <br /> Construction Costs for Lake Valentine Road Improvements dated July 31, 2020, on file with the City, <br /> which costs estimates may change as the Improvements are installed. The Developer agrees to pay any <br /> costs incurred by the City, less the cash requirement previously paid of$40,054.00 for the Lake Valentine <br /> Road Improvement Study, in conjunction with the installation, construction, and perpetual operation and <br /> maintenance of the Improvements, including but not limited to legal, planning, engineering and inspection <br /> expenses incurred in connection with approval and acceptance of the Improvements, the preparation of this <br /> Agreement, review of construction plans and documents, all costs and expenses incurred by the City in <br /> monitoring and inspecting the installation and construction of the Improvements, and electrical service and <br /> repair costs for the signal system. <br /> 3 <br /> 211093v2 <br />
