The final concrete curb, sidewalk, curb ramps, pavement markings, and pavement work shall be installed before November 17, 2020. The signal system shall be installed and fully functional before February 15, 2021. The Developer may, however, request an extension of time from the City. If an extension is granted, it shall be conditioned upon updating the security posted by the Developer to reflect cost increases and the extended completion date. Final wear course placement must have the written approval of the City Engineer, and may be delayed or scheduled at any time of the year based upon existing site conditions at the discretion of the City Engineer. 4. The Developer warrants all Improvements required to be constructed by it pursuant to this Agreement for a period of twenty-four(24) months from the date of acceptance by the City against poor material and faulty workmanship. 5. The Developer shall pay all costs incurred pursuant to the Engineer's Opinion of Probable Construction Costs for Lake Valentine Road Improvements dated July 31, 2020, on file with the City, which costs estimates may change as the Improvements are installed. The Developer agrees to pay any costs incurred by the City, less the cash requirement previously paid of$40,054.00 for the Lake Valentine Road Improvement Study, in conjunction with the installation, construction, and perpetual operation and maintenance of the Improvements, including but not limited to legal, planning, engineering and inspection expenses incurred in connection with approval and acceptance of the Improvements, the preparation of this Agreement, review of construction plans and documents, all costs and expenses incurred by the City in monitoring and inspecting the installation and construction of the Improvements, and electrical service and repair costs for the signal system. 3 211093v2
