The applicant is requesting approval of a side yard setback variance (3 feet 3 <br />inches proposed, when 10 feet is required) for a new garage on a single-family lot zoned <br />R-l (Exhibit A), <br />Background. The applicant currently has a 399 square foot (19 by 21 feet) detached <br />garage, The detached garage is currently 3 feet 3 inches from the East property line <br />side). The applicant wishes to demolish the existing garage and rebuild the detached <br />garage in approximately the same location, The proposed garage would be 528 square <br />feet (22 by 24 feet) which is larger than the existing garage. The setback from the side <br />property line would remain 3 feet. <br />The garage needs to be at least 6 feet from the house to meet the building code. The <br />existing garage is 12 feet from the house. The proposed garage would be 7 feet from the <br />house, Due to the pie shaped lot and significant trees the applicant would have a difficult <br />time building on the west side of the home, <br />Several similar variances have been granted in this neighborhood including one for the <br />neighbor to the east at 1426 County Road E (pC # 97-11), The City, in Planning Case <br />97-11, approved the variance for a three (3) foot three (3) inch setback to the side yard <br />setback for an accessory structure, The basis for the variance was that the parcel was <br />deficient in lot width. The City, in Planning Case # 93-08 (Bernard Ortt ,1419 Arden <br />Place), approved a variance for an accessory structure which was 5 feet from the property <br />line, when 10 feet is required. The basis for the variance was that ifthe side yard setback <br />was met, three mature oaks would need to be removed to accommodate the proposed <br />structure. The City, in Planning Case # 82-21 (Howard Kern, 1400 County Road E), <br />approved a five (5) foot side yard setback for a garage addition when ten was required, <br />The basis for the approval was that the garage was already at five (5) feet and the lot had <br />a substandard width. <br />The applicant could minimize this request by reducing the garage width to a standard 22 <br />feet and then only need a 5 foot variance where 40 is required, The garage could also be <br />moved one foot closer to the house and still meet the building code, <br />Findinl!"s - side vard accessorv structure setback variance (detached l!"aral!"e).
