I. As a condition of approval,all required improvements,including sewer,water, <br /> utilities and driveway connections to Pine Tree Drive will be constructed in accordance with the City's <br /> subdivision code. <br /> J. As a condition of approval,the Developer shall construct a six(6')foot wide <br /> sidewalk along the realigned section of the private driveway extending from Pine Tree Drive to Lot 3. <br /> K. As a condition of approval,the Developer shall construct a six(6')foot wide <br /> sidewalk along the west side of Pine Tree Drive from Outlot A to the north boundary of"Exception <br /> Parcel C"upon the development of Lot 2 or relocation of the private driveway. <br /> L. As a condition of approval,all trails currently located on Lot 3, Block 1, shall <br /> remain open to the public. <br /> M. Prior to release of the final plat,the property owner of Lot 1, Block 1, shall <br /> submit a maintenance plan for the existing trails on Lot 1, Block 1,unless the City and owner of Lot 1, <br /> Block 1 have entered into a written agreement establishing different requirements. <br /> N. As a condition of approval,the Developer shall provide a maintenance agreement <br /> for Outlot A to be recorded upon the property. All maintenance responsibilities,including,but not limited <br /> to,plowing,mowing and repairs to the street pavement, street lights, drainage and utilities for Outlot A <br /> shall be completed by the owner of Lot 3, Block 1,unless a separate maintenance agreement has been <br /> entered into between the Developer and the owner of Lot 3, Block 1. <br /> O. As a condition of approval,the Developer shall provide a cross access agreement <br /> for Outlot A to be recorded upon the property for the purpose of establishing vehicular and pedestrian <br /> access to Pine Tree Drive for Lot 1, Lot 2 and Lot 3. <br /> 29. SUMMARY OF SECURITY REQUIREMENTS. To guarantee compliance with the <br /> terms of this Agreement,payment of the costs of all improvements,and construction of all public and <br /> private improvements,the Developer shall furnish the City with a letter of credit,in the form attached <br /> hereto,from a bank("security")for$818,125.00.
