The proposed Preliminary Plat and Final Plat are consistent with the Arden Hills Zoning Map <br />and the 2040 Comprehensive Plan. <br />11. The application is not anticipated to create a negative impact on the immediate area or the <br />community as a whole. <br /> <br />Options and Motion Language <br /> <br />The Planning Commission reviewed this application at their September 9, 2020 meeting. At that <br />time, they recommended approval of Summit Development’s application for a Site Plan Review, <br />Planned Unit Development, Conditional Use Permit, Preliminary Plat and Final Plat by a 7-0 vote. <br />The following are motion language options for the City Council to consider. <br /> <br />A Conditional Use Permit is required for warehousing uses within the Gateway Business <br />District. <br /> <br />1. Approval: Motion to adopt Resolution 2020-045, approving the Conditional Use for Planning <br />Case 20-010 at 4200 Round Lake Road, based on the findings of fact and the submitted <br />materials. <br />2. Denial: Motion to deny Resolution 2020-045, for a Conditional Use for Planning Case 20-010 <br />at 4200 Round Lake Road, based on the following findings of fact: findings to deny should <br />specifically reference the reasons for denial and why those reasons cannot be mitigated. <br />3. Table: Motion to table Resolution 2020-045, for a Conditional Use for Planning Case 20-010 <br />at 4200 Round Lake Road for the following reasons: a specific reason and/or information <br />request should be included with a motion to table. <br />Planned Unit Development, Site Plan, Preliminary and Final Plat <br /> <br />1. Recommend Approval with Conditions: Motion to recommend approval of Planning Case 20- <br />010 for a Planned Unit Development, Site Plan Review, Preliminary and Final Plat at 4200 <br />Round Lake Road, based on the findings of fact and submitted plans, subject to the following <br />conditions: <br />1. The project shall be completed in accordance with the plans submitted and as amended <br />by the conditions of approval. Any significant changes to the plans, as determined by <br />the City Planner, shall require review and approval by the City Council. <br />2. The Preliminary Plat approval shall expire six months from the date of the City Council <br />approval unless the Final Plat has recorded with Ramsey County or a time extension <br />granted by the City Council. <br />3. The Applicant shall record the Final Plat with Ramsey County and a copy shall be <br />provided to the City within sixty (90) days of the City’s approval. <br />4. The Applicant shall be financially responsible for all applicable water and sanitary <br />charges. Rates applied shall be those in effect at the time of Final Plat approval and <br />shall be memorialized in the Development Agreement. <br />5. A Development Agreement shall be prepared by the City Attorney and subject to City <br />Council approval. The Development Agreement shall be fully executed prior to release <br />of a building permit. <br />6. The Applicant shall submit a park dedication fee that shall be seven and a half (7.5) <br />percent of the fair market value of the unimproved land and subject to the approval of
