Waste Container <br />Page 2 of 3 <br />Proposed Language <br /> <br />Staff offers the following language for City Code Section 660.05, Subd. 8, <br /> <br /> “Refuse and recycling containers from single-family dwellings shall be placed at the <br />end of the driveway after 6:00 p.m. the night before, or anytime on the day of <br />collection. Waste containers shall not be placed within any public street. Containers <br />shall be removed after pickup on the scheduled collection day.” <br /> <br />Findings of Fact <br /> <br />Staff offers the following findings for consideration as to whether or not the proposed application <br />would adversely affect the community as a whole based on the aforementioned factors: <br /> <br />General Findings: <br />1. The City of Arden Hills is proposing amendments to the language of Chapter 6 of the <br />Nuisance Code. <br />2. Under City Code Section 660.05, the language of this code section does not address the <br />location in which the containers may be placed on trash day. <br />3. Staff received complaints regarding the placement of waste containers within the street and <br />discovered waste containers were blocking the travel portion of the public right-of-way. <br />4. The proposed language offered by staff would specify what locations are permitted for the <br />placement of waste containers on collection day. <br /> <br />Council shall consider <br /> <br />Staff presents motion language options for Planning Case 20-019. The following are motion <br />language options for the City Council to consider. <br /> <br />1. Approval: Motion to approve Planning Case 20-019 for a Nuisance Code Amendment to <br />Chapter 6 based on the findings of fact and the October 26, 2020 Report to the City Council. <br /> <br />2. Approval with Amendments: Motion to approve Planning Case 20-019 for a Nuisance <br />Code Amendment to Chapter 6 based on the findings of fact and the October 26, 2020 <br />Report to the City Council with amendments. <br /> <br />3. Denial: Motion to deny Planning Case 20-019 for a Nuisance Code Amendment to Chapter <br />6, based on the following findings of fact: findings to deny should specifically reference <br />the reasons for denial and why those reasons cannot be mitigated. <br /> <br />4. Table: Motion to table Planning Case 20-019 for a Nuisance Code Amendment to Chapter <br />6 for the following reasons: a specific reason and/or information request should be <br />included with a motion to table. <br /> <br /> <br />
