Page 1 of 2 <br /> <br />CONSENT ITEM – 6G <br /> <br />MEMORANDUM <br /> <br />DATE: February 8, 2021 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> <br />FROM: Mike Mrosla, Community Development Manager/City Planner <br /> <br />SUBJECT: Release of Previously Approved Planned Unit Developments and Termination of <br />Declaration of Covenant Restrictions at 4200 Round Lake Road <br /> <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> N/A N/A N/A <br /> <br />Council Should Consider <br /> <br />Motions to approve, table, or deny the following: <br /> <br />• Release of previously approved Planned Unit Developments and termination of <br />declaration of covenant restrictions at 4200 Round Lake Road. <br /> <br />This items requires a simple majority. <br /> <br />Background <br /> <br />At its March 26, 2001, the Arden Hills City Council approved a Final Plat and Master Plan <br />Planned Unit Development (PUD) application from Chesapeake Companies for the Subject <br />Property at 4200 Round Lake Road (“Subject Property”) located at the northeast intersection <br />Interstates 35W and 694 subject (Attachment A). At that time the Subject Property was <br />subdivided into three (3) lots of record (Attachment B) and the City imposed restrictions that no <br />building permits shall be issued unless all three (3) parcels were part of a PUD. The property <br />owner at that time decided to create a private covenant that ran with the land to implement this <br />condition of approval. Since then the Subject property had numerous PUD’s amendments and a <br />lot consolidation occurred in 2007 where the three (3) lots were combined into one (1) parcel <br />(Attachment B). The current request to terminate the private covenant should have occurred <br />during the previous lot consolidation. <br /> <br />At its October 12, 2020 meeting the City Council approved a Master Planned Unit Development, <br />Conditional Use Permit, Site Plan and Preliminary/Final Plat for Scannell Properties.
