The attorney for Scannell Properties has <br />requested to clear title. The effect of the releases are to free the new parcel from any previously <br />approved PUD’s and other restrictions previously recorded against the property. The recently <br />approved PUD will govern the properties going forward. The City Attorney has reviewed and <br />approved the release of covenants on the condition that Scannell Properties executes and records <br />the new PUD development agreement prior to the recording of the release document to ensure no <br />gap in coverage occurs. <br /> <br />Options and Motion Language <br /> <br />Staff has provided the following motion language for this case. <br /> <br />1. Recommend Approval: Motion to recommend approval of the release of previously approved <br />Planned Unit Developments and termination of declaration of covenant restrictions at 4200 <br />Round Lake Road on the condition that the new PUD Development Agreement shall be <br />executed and recorded prior to the recording of the release document to ensure no gap in <br />coverage occurs. <br /> <br />2. Recommend Denial: Motion to recommend denial of the release of previously approved <br />Planned Unit Developments and termination of declaration of covenant restrictions at 4200 <br />Round Lake Road: the City Council should identify findings to deny and should specifically <br />reference the reasons for denial and why those reasons cannot be mitigated. <br /> <br />3.
