Master Plan PUD, Final PUD\PC Packets <br />Page 5 of 12 <br />The applicant is requesting flexibility of setback requirements for the two canopies proposed on <br />the site. A dual drive-thru lane is proposed to start on the north side of the parking lot, curl around <br />to the west side of building, and end on the south side of the building. The drive thru lane has been <br />positioned in a way to promote circulation on the exterior of the site in order to prevent backups <br />within the parking lot. The applicant is proposing to install two free-standing canopies over the <br />drive-thru lane: An order point canopy to be located north of the building, setback 14.7 feet from <br />the property line; and an order meal delivery canopy to be located on the west side of the building, <br />over the pick-up window, setback 2.3 feet from the property line. The Zoning Code requires <br />accessory structures to be setback 10 feet from the property line in the B-3 District. <br /> <br />Section 1325.04 of the Zoning Code lists special requirements for drive-up facilities. One of these <br />requirements states no drive up facility shall be located within 1,320’ of another facility. The <br />nearest drive-up facility is the Starbucks, located to the south across Red Fox Road. Section <br />1320.09 allows this requirement to be waived if the following conditions are met: <br /> <br />A. The operation consists of one or more drive-up windows and is an integral part of a building <br />containing one or more other allowed uses, or the operation is part of an architecturally <br />unified complex containing two or more businesses using drive-up windows <br />B. Shared access drives and shared parking are utilized by all such businesses using drive-up <br />windows in said building or complex. <br />C. Only one building or architecturally unified complex containing two or more businesses <br />using drive-up windows will be allowed in addition to one freestanding business using a <br />drive-up window. <br />D. The architecture and the site, grading, circulation, landscaping, screening and signage plans <br />shall unify the appearance and function of the complex or building. <br />E. An architecturally unified complex may consist of one or more buildings on one or more <br />parcels if the intent of providing a unified appearance and function is not compromised. <br />F. The applicant shall submit a circulation plan that demonstrates that the use will not interfere <br />or reduce the safety of non-motorized movements, specifically pedestrian and bicyclists. <br /> <br />Section 1325.04 also requires any electronic devices, including loudspeakers, be located at least <br />50’ from any lot line. The nearest order box on the west side of the site is located approximately <br />20’ from the west property boundary. The applicant is requesting flexibility from this <br />requirements. <br /> <br />C. Landscaping and Tree Preservation – Section 1325.05 Subd. 1 and 1325.055 <br /> <br />Minimum Caliper Inches – Meets Requirements <br />The Zoning Code requires that a minimum number of caliper inches of trees be provided based on <br />the gross square footage of the building on the property. The proposed building includes 4,995 <br />gross square feet. This requires a minimum of 15.6 caliper inches. Section 1325.055, Subd. 6, 3, <br />e, of the Zoning Code allows preserved trees on the site to count towards the required landscaping. <br />There are 183 existing caliper inches of significant trees on the site. At least 117 significant caliper <br />inches will remain after tree removal. This meets the minimum caliper inches required. <br /> <br /> <br />
