-Allow businesses to utilize outdoor space adjacent to their typical location if the business: <br />-Complies with all the Governor’s guidance regarding safe business operations including <br />a social distancing plan. <br /> -ADA guidelines are observed. <br /> -Safe pedestrian flow must be maintained. <br /> -Cannot conflict with any building codes or requirements. <br />-If portions of a parking lot are being used, safe pedestrian and traffic flow must be <br />maintained. Adequate parking spaces must be maintained. A substantial barrier must <br />divide outdoor space being used for customers and traffic flow. <br />-Public Safety response must not be infringed upon. <br />-The proposed outdoor space will not be on City property or right-of-way. <br />-If the business is not the property owner, the business must receive consent to use the <br />proposed space. <br />-Expansion or use of outdoor space is on a case-by-case basis and will be reviewed by <br />City Staff. <br /> <br />-If a restaurant or bar wants to utilize outdoor space and serve alcohol it must comply with the <br />above requirements and: <br /> -Alcoholic drinks must be consumed on premise. <br />-The outdoor area must be contiguous to the building and contained, an updated map <br />must be provided to City Staff showing where the consumption would take place. <br />-Must provide an updated certificate of insurance regarding liability coverage extending <br />to an outdoor space. <br />-Must comply with all other local and state regulations regarding alcohol sales and <br />consumption. <br /> <br />A draft resolution is attached for Council review should Council want to vote on it or give <br />further guidance for its meeting on May 28, 2020. <br /> <br />The temporary authority given to staff to review any requests that come in would be until <br />restaurants can resume normal operations or further Council direction is received. <br /> <br />Budget Impact <br /> <br />N/A <br /> <br />Attachment <br /> <br />Attachment A: Resolution 2020-024
