<br />2021-07-12 Final Version 6 <br />responsible for design changes and contract administration between the Developer and the <br />Developer's contractor. The Developer or his engineer shall schedule a pre-construction meeting <br />at a mutually agreeable time at the City Council chambers with all parties concerned, including <br />the City staff, to review the program for the construction work. Developer will install sidewalks <br />just prior to the installation of the final lift of asphalt. <br /> 9. OWNERSHIP OF IMPROVEMENTS. Developer shall notify the City upon <br />completion of all curb, gutter, streets, roadways, sidewalks, lighting, signage, lawn, landscaping, <br />and utility infrastructure (collectively, the “Public Improvements”) lying within public <br />easements, and the City shall inspect the completed Public Improvements and notify Developer <br />if any of the Public Improvements do not conform to the requirements of this Agreement. Upon <br />compliance with this Agreement with respect to the Public Improvements, the City shall give <br />formal notice of acceptance to Developer and upon such notice, the Public Improvements shall <br />become City property without further notice or action, and thereafter Developer shall have no <br />responsibility with respect to the maintenance, repair, or replacement of the Public <br />Improvements, except during any warranty periods. <br /> The Developer shall, at its expense, prepare any streets included within the Public <br />Improvements for snowplowing and other maintenance prior to formal acceptance by the City of <br />such streets. This preparation shall include, without limitations, ramping any manholes as <br />necessary to avoid damage to snowplows or other vehicles used in street maintenance. Should <br />damage occur to City snowplows or other vehicles during the course of snowplowing or other <br />maintenance procedures prior to formal acceptance of the street by the City, the Developer shall <br />pay all such damages and shall indemnify and hold the City harmless for all such damage, cost, <br />or expense incurred by the City with regard thereto.
