tli-., <br />LGZIS Lease for Lawful Gambling Activity 6/tS Page 2 of 2 <br />Other Prohlbltlons: The lessor wlll not lmpose restrlcflons on <br />the organlzation with respect to providers (distributor or linked <br />blngo game provlder) of gambling-related equlpment and ser- <br />vices or in the use of net profits for lawful purposes. <br />The lessor, the lessor's lmmedlatd fbmily, Bhy person reslding in <br />the same resldence as the lessor, and any agents or employees <br />of the lessor wlll not requlre the organlzatlon to perform any <br />actlon that would vlolate statute or rule. The lessor must not <br />modlfy or termlnate thls lease ln whole or in part due to the <br />lessor's vlolatlon of thls provlslon. If there ls a dlspute as to <br />whether a vlolatlon occurred, the lease wlll remain in effect pend- <br />lng a final determlnatlon by the Compllance Review Group (CRG) <br />of the Board. The lessor agrees to arbitration when a violation of <br />thls provlslon ls alleged. The arbitrator shall be the CRG. <br />Access to Permltted Premlees: Consent is glven to the Board <br />and lts agents, the commissioners of revenue and public safety <br />and thelr agents, and law enforcement personnel to enter and <br />lnspect the permitted premlseg at any reasonable time during the <br />buslness hours of the lessor. The organization has access to the <br />premises during any tlme reasonable and when necessary for the <br />conduct of lawful gambllng. <br />Leccor Recorde: The lessor must maintaln a record of all <br />money recelved from the organizatlon, and make the record <br />available to the Board and lts agents, and the commissloners of <br />revenue and public safety and their agents upon demand. The <br />record must be maintalned for 3-L/2 years. <br />Rent All-Incluslve: Amounts pald as rent by the organizatlon <br />to the'lessor?re all-lnclusive, No other servlces or expenses <br />provlded or contracted by the lessor may be paid by the organi- <br />zatlon, lncluding but not limited to:- trash removal <br />electrlcity, heat <br />;-rCvV i'€ITIOVEi <br />rage <br />itorlal and cleaning services <br />er utilitles or servlces <br />awn services <br />rity, securlty monltorlng <br />of any communlcation neti^rork or servlce required to <br />nduct electronlc pull-tabs games or electronic bingo <br />n the case of bar operatlons, cash shortages. <br />Any er expendltures made by an organization that ls related <br />toa eased premlses must be approved by the dlrector of the <br />Bqa . Rent payments may not be made to an lndlvldual. <br />& <br />Leace Term: The term of thls agreement wlll be concurrent <br />wlth the premlses permlt lssued by the Gambllng Control Board <br />(Board). <br />Management: The owner of the premlses or the lessor wlll not <br />manage the conduct of lawful garmbllng at the premises. The <br />organlzatlon may not conduct any activity on behalf of the lessor <br />on thq leased'premlses. <br />Partlclpatlon sr Playcru Prohiblted: The lessor wlll not par- <br />ticlpate dlrectly or indirectly as a player in any lawful gambling <br />conducted on the premlses, The lessor's lmmediate famlly and <br />any agents or gambllng employees of the lessor wlll not partlcl- <br />pate as players ln the'conduct of lawful gambllng on the premls- <br />es, except as authorlzed by Minnesota Statutes, Section <br />349.181. <br />Illega! Gambllng: The lessor ls aware of the prohlbltion <br />agalnst lllegal gambllng ln Mlnnesota Statutes 609.75, and thO <br />penaltles for lllegal gambling violi'tlons ln Minnesota Rules <br />7865.0220, Subpart 3. In addition, the Board may authorize the <br />organlzation to withhold rent for,g perlod of up to 90 days lf the <br />Board determlnes that lllegal gambllng occulred on the premlses <br />or that the lessor or lts employees paftlclpated ln the lllegal <br />gambling or knew of the gambllng and dld hot take prompt <br />actlon to stop the gambllng. ConUnued tenancy of the organlza- <br />tion ls authorlzed wlthout payment of rent durlng the tlme period <br />determlned by the Board for vlolatlons of thls provision, as <br />authorlzed by Minnesota Statutes, Sectlon 349.18, Subd. 1(a). <br />To the best of the lessor's knowledEe, the lessor afflrms that ony <br />and all games or devlces located'0n the premises are not belng <br />used, and aft, not capable of belng used, ln a manner that <br />vlolates the prohlbltions against illegal gambling ln Mlnntisota <br />Statutes.
