Pursuant to paragraph 33E of the Development Contract/PUD, all amendments to <br />the Development Contract or Planned Unit Development shall be in writing, signed by the parties, <br />and approved by written resolution of the City Council. <br /> <br /> E. The City Council has reviewed and approved the proposed application submitted <br />by the Developer. <br /> <br /> NOW, THEREFORE, in consideration of the premises and the mutual obligations of the <br />parties hereto, the parties agree as follows: <br /> 1. The City hereby grants approval to the Developer’s request for an amendment to <br />the Development Contract/PUD in seeking flexibility to allow sign standards as permitted under <br />Sign District 4, conditioned upon the following: <br /> A separate sign permit shall be required and multi-tenant signage must meet all <br />requirements of City Code Chapter 12. <br /> Prior to issuance of a sign permit, Developer shall submit its final sign plans to the City <br />for review and final approval. <br /> Prior to issuance of a sign permit, the Developer shall provide City Staff with a written <br />statement from New Perspective Senior Living and the owner of Lot 1, Block 1, 2 Pine <br />Tree Drive, of their intent to forego a single-tenant monument sign and agreeing to the <br />placement and utilization of the on-premise multi-tenant sign under the Development <br />Contract/PUD. <br /> All signage shall meet the requirements of Sign District 4. <br /> This Amendment shall limit Outlot A to only one freestanding sign, regardless of who <br />owns or has an interest in the Outlot. <br /> <br /> 2. The City hereby approves the additional Development Contract/PUD amendments <br />as outlined in the Recitals above. <br /> 3. Developer shall comply with all applicable conditions of the original Development <br />Contract and Planned Unit Development recorded as Ramsey County Document No. A4839370. <br /> 4. Except as otherwise specifically amended herein, the Development Contract/PUD <br />shall remain in full force and effect. This Amendment shall be binding on the parties, their heirs, <br />successors and assigns and shall be recorded against the Property in the office of the Ramsey <br />County Recorder as promptly as possible after it has been executed by the parties.
