David Perrault <br />10-04-21 <br />Page 2 <br />Annual Aggregate Deductible (GAAD), if any, shown in the Common Coverage Declarations. <br /> <br />This claim was handled under your Covenant Number CMC 1001318-3 with a coverage period <br />from January 1, 2019 to January 1, 2020. Under this covenant, there is a Municipal Liability <br />Deductible of $10,000 per occurrence and a GAAD of $20,000. If the GAAD is satisfied, there is <br />a Maintenance Deductible of $1,000 per occurrence. I have confirmed that the city has not <br />satisfied the GAAD. As such, the applicable deductible for this claim is $10,000. <br /> <br />The deductible is applied to the percentage of the costs that would otherwise be paid by LMCIT. <br />The city’s co-pay amounts (i.e., the percentages of litigation costs for which the city is responsible) <br />do not count toward satisfying the city’s deductible. <br /> <br />The city’s responsibility is as follows: <br /> <br />Deductible = $10,000.00 <br />15% co-payment on litigation costs from $25,000 to $250,000 = $33,750.00 <br />40% co-payment on litigation costs in excess of $250,000 = $217,710.38 <br />Total = $261,460.38 <br /> <br />Please issue a check for $261,460.38 payable to LMCIT and forward it to this office.
