SUBDIVISIONS § 22.9 <br /> Sec. 22-9. Public sites and open spaces. <br /> (a) Drainage channels. Where a proposed drainage <br /> channel shown in the city plan is located in whole or in part <br /> within a proposed subdivision, the subdivider shall dedicate <br /> adequate space for such purpose within the subdivision <br /> when the city council finds that the channel is reasonably <br /> necessary to the public health and welfare. <br /> (b) Parks and playgrounds. <br /> (1) Residential subdivisions. The subdivider of any tract <br /> of land which is to be developed for residential uses <br /> shall dedicate to the public for public use as parks, <br /> playgrounds, public open space, or storm water <br /> holding areas or ponds, that percentage of the tract to <br /> be subdivided which corresponds with the applicable <br /> density of the subdivision in the following schedule: <br /> Gross density Percentage <br /> 0 to 2 dwelling units per acre . . . . . . . . . 10 <br /> Over 2 to 3 dwelling units per acre . . . . 11 <br /> Over 3 to 4 dwelling units per acre . . . . 12 <br /> If the density of the proposed residential subdivision <br /> exceeds four (4) dwelling units per acre, the city <br /> council shall require the dedication of such percentage <br /> of the proposed subdivision as it deems reasonable <br /> and in the public interest, which percentage shall in <br /> no event be less than twelve (12) nor more than fifteen <br /> (15). <br /> (2) Commercial, industrial, and other developments, or <br /> planned unit developments providing a mixture of <br /> residential, commercial, industrial, and other uses. <br /> This subparagraph is specifically made applicable to <br /> all developments of land in the city for commercial, <br /> industrial, and other uses, or planned unit develop- <br /> ments thereof providing for a mixture of residential, <br /> commercial, industrial, or other uses, regardless of <br /> whether such developments are subdivisions within <br /> the context of this chapter or any of the other <br /> 1293 <br /> • <br />
