• § 22-9 ARDEN HILLS CO <br /> DE <br /> provisions of this chapter apply to such developments. <br /> The purpose and intent of this subparagraph is to <br /> assure the citizens of the city that additional open <br /> space, parks, playgrounds, and recreational facilities <br /> will be a concomitant of every sort of new develop- <br /> ment in the city, not just residential development, so <br /> that the city's present vast amount of privately owned <br /> open spaces with potential for development do not <br /> become exclusively filled with residential, industrial, <br /> commercial, and other uses; to secure for the residents <br /> of the city the social and physical advantages <br /> resulting from the provision of orderly park, re- <br /> creational and open space facilities; to insure that in <br /> fact such facilities will be provided; and to preserve, <br /> enhance, and improve the quality of the physical <br /> environment of the city. <br /> In accordance with the purpose and intent of this <br /> subparagraph, the developer of any tract of land in <br /> the city which is to be developed for any of the uses <br /> enumerated in the first sentence of this subparagraph <br /> shall dedicate to the public for public use as parks, <br /> • playgrounds, public open space, or storm water <br /> holding areas or ponds, such portion of his develop- <br /> ment tract, not to exceed fifteen (15) per cent thereof, <br /> as the city council deems to be reasonable and in the <br /> public interest, taking into consideration the locale of <br /> the development tract and the accessibility and <br /> serviceability which the proposed area to be dedicated <br /> for such public uses will provide for existing and <br /> future residents of the city. <br /> (3) Delineation of area to be dedicated. The actual area to <br /> be dedicated for public use as <br /> parks, playgrounds, <br /> public open space, or storm water holding areas or <br /> ponds shall be delineated, in the case of a residential <br /> subdivision under subparagraph (1) above, on the <br /> subdivider's preliminary plat as required by section <br /> 22-5(c)(8) hereof, and, in case of a development within <br /> the purview of subparagraph (2) above, on the <br /> developer's site plan in addition to those items <br /> 1294 <br /> • <br />
