DONNELLY(r.IlrlC) <br /> Ms. Charlotte McNiesh <br /> Clerk-Administrator <br /> City of Arden Hills <br /> City Hall <br /> 1450 West Highway 96 <br /> Arden Hills, Minnesota 55112 <br /> Re : Pull-Tabs at Blue Fox Inn <br /> Dear Charlotte: <br /> • At your request, I have reviewed Chapter 349 of <br /> Minnesota Statutes to determine whether the City is a valid <br /> recipient of funds derived from a pull-tab operation to be <br /> conducted on the premises of the Blue Fox Inn and what, if any, <br /> responsibility or liability the City will have in connection with <br /> such operation as a result of its being a recipient of such <br /> funds. <br /> Section 349 . 11 of Minnesota Statutes , as amended, says <br /> that the purpose of Chapter 349 is, among other things, " . . . to <br /> provide for the use of net profits only for lawful purposes. <br /> The term "lawful purpose" is defined in Section 349. 12 , Subd. 11 <br /> to include , in pertinent part, " . . . lessening the burdens borne <br /> by government or voluntarily supporting, augmenting or <br /> supplementing services which government would normally render to <br /> the people . . . " . The term, however, does not include <br /> the erection or acquisition of any real property, unless the <br /> board specifically authorizes the expenditures after finding that <br /> the property will be used exclusively for one or more of the <br /> purposes specified in this clause. " Section 349 . 15 provides that <br /> profits from a pull-tab operation may be utilized only for <br /> "lawful purposes" as authorized at a regular meeting of the <br /> conducting organization. <br /> In light of the foregoing, the City may be the <br /> recipient of proceeds from the pull-tab operation so long as <br /> those proceeds are to be used to lessen the burdens of government <br /> or in supporting, augmenting or supplementing services which <br /> 1 <br />
