4. Construction shall include the provision for an imporved and surfaced <br /> parking area to accommodate up to 200 automobiles. The City shall have the right <br /> to use said parking facilities when they are not being used by military personnel , <br /> to accommodate persons using the armory or community center. This shall not in- <br /> clude storage of utility or maintenance vehicles. <br /> 5. The City will grant to the Commission* easements for roads, electrical , <br /> sewer, water and natural gas connections from the Cities' in place facilities. <br /> Roads, electrical , sewer, water and natural gas extensions shall be considered <br /> a "basic cost" of construction or, if they exceed the scope for which Federal <br /> support is authorized, additional costs will be shared equally. These shall <br /> be agreed to by the parties and shall be located in a manner to protect the <br /> amenities on the City site and to minimize the costs of the armory in providing <br /> sewer and water to the building. <br /> 6. The City and Commission agree to coordinate and cooperate to insure <br /> that the building grounds, and the facility itself, are maintained in accordance <br /> with area standards. <br /> 7. The City shall provide janitorial service, snow removal and groundskeeping <br /> as set forth in the lease agreement referenced below, and shall be reimbursed or <br /> credited by the Commission for that portion of the reasonable value of these <br /> services relating to the National Guard's prorata share of the use of the facilities, <br /> the City assuming the cost of its pro-rata share. The City shall pay its pro-rata <br /> share of other operating costs (including water, sewer, electricity, heating and <br /> • other services and utilities) relating to the city's use of the facilities, and a <br /> pro-rata share of major or capital maintenance (sometimes called "repair, replace- <br /> ment, or betterment") which shall be necessitated by the City's use of the premises <br /> causing breakage to or more rapid deterioration of the facilities. . Mindful that a <br /> precise division of such costs between the City and the Commission may be impossible <br /> or impractical , it is understood that the parties will mutually agree to a rea- <br /> sonable formula designed to approximate such a proration based upon the first 12 <br /> months of occupancy. The formula will be reviewed annually, or more frequently <br /> by mutual agreement of the parties. Payment of these operating costs by the City <br /> to the Commission shall be on a monthly billing basis. Contribution by the City <br /> of services or utilities in kind may be substituted for cash payment by prior <br /> agreement with the commission if such is deemed by both parties to be in their <br /> mutual best interest. For the period prior to the aforementioned formula being <br /> negotiated, the City will compensate the Commission in cash and/or in services <br /> in an agreed sum or manner which will bear a reasonable relation to the City' s <br /> declared usage of the facility. The City will provide the local Armory Board with a <br /> written schedule of its desired use of the armory's facilities one year in advance <br /> which will be incorporated into a lease adhering to the requirements of Minnesota <br /> National Guard Regulation 420-70 (1 October 1982) and which will govern the use of <br /> the facility. The Armory Board will do its best to accommodate these desires pur- <br /> suant to the City's sharing of operating costs. Any revenue-producing uses other <br /> than by the City itself shall be contracted by the Armory Board directly with the <br /> user. <br /> 8. The Armory Commission shall be responsible for maintenance of the facilities <br /> . behind the front building line which includes any specially fenced secure area for <br /> military vehicles or any accessory building utilized to store government equipment. <br /> This does not apply to janitorial service, snow removal and groundskeeping, which <br /> are addressed in paragraph 7 above. <br /> -3- <br />
