.MINUTES OF THE ARDEN HILLS REGULAR COUNCIL MEETING " �'�-� ' of '�1`' d8':o Ilia: r, �,�,��.. , Monday, December 28, 1987, 7:00 p.m. - Village Hall ` CALL TO ORDER Pursuant to due call and notice thereof, Mayor Woodburn called the meeting to order at 7:00 p.m. ROLL CALL The roll being called the following members were present: Mayor Robert Woodburn, Councilmembers Thomas Sather, Gary Peck and Jeanne Winiecki. Absent: Councilmember Nancy Hansen. An o present: Attorney James Lynden, Treasurer Frank Green, Public Works Supervisor Robert Raddatz, Clerk Administrator Patricia Morrison and Deputy Clerk Catherine Iago. CLOSED MEETING; Council discussed labor negotiations at a closed meeting LABOR NEGOTIATIONS between 7:00 and 7:30 p.m. APPROVE MINUTES Clerk Administrator Morrison advised Council that Robert Freed had requested the following change in Minutes of the December 14, 1987 Regular Council Meeting: Under Rendering Plant; 1988 Agreement, page 1, paragraph 3, line 3: Delete the word "Village"and insert the initials "MPCA". Peck moved, seconded by Winiecki, that Council approve the minutes of the Regular Council Meeitng of December 14, 1987, with the change as outlined by the Clerk Administrator. Motion carried unanimously. (4-0) BUSINESS FROM FLOOR ARMY RESERVE Tom Mulcahy, 3530 Siems Court, appeared before Council TRN'G CENTER to offer comments on the Army Reserve Training Facility proposed for construction at the arsenal. Mulcahy remarked that the City's response to the request should be well considered and developed after consultation with those parties that can offer meaningful input. He commented that the Army could accomplish the project without use of the prime location on the arsenal site. Mulcahy noted that the land may be unsuitable for private development, due to the pollutants that contaminate the land. He suggested that the easterly portion of the land, that is not occupied by army facilities, should be preserved for open space or parkland development. Mulcahy suggested the City of Arden Hills join with neighboring communities to solve the problem in a creative way; a plan that would solve the army's training needs, as well as preserve the natural asset in our midst for public use and enjoyment. Council thanked Mulcahy for his comments. KEM MILLING CO. ; Council was referrred to a letter from Attorney Lynden, 1988 AGREEMENT 12-24-87, regarding the initial draft of the revised agreement between the City and Kem Milling Company. Lynden advised that Mr. Guzek and Kem Milling's attorney, Mr. Johnson, had been sent copies of the revised agreement; Johnson has not had a chance to review the agreement. Lynden reviewed the agreement revisions, which relate to: - Tests of the odor emission stacks and ambient air; increase number per year and conduct in conformity with American Society for testing materials method D-1391-57; - Hiring an independent testing organization, chosen by City; costs of the testing to be borne by the Company; - Immediate access to the plant for testing be provided upon request of the testing organization chosen by the City, City Officials, and groups or individuals designated by the City. - Kem Milling Company agreement to cooperate with an independent consultant, selected by the City, to employ computer modeling techniques similar to those used by MPCA, to detect odor units emitted into the ambient air; further agrees to cooperate with the consultant to develop alternative solutions (if ambient air exceeds limits established in Minnesota Rules cited) to improve the plant odor emission control equipment in order to • bring the ambient air odor emissions into compliance with said Minnesota Rules.
