Approvals <br /> <br />The Planning Commission is being asked to determine whether a variance request for flexibility <br />on the front yard setback should be approved. A site plan overlaid on the certificate of survey has <br />been submitted showing the location of the proposed dwelling. The evaluation of the proposal <br />should be based on the District Provisions in Section 1320, Shoreland Regulations in Section 1330, <br />and the Requirements for a Variance in Section 1355.04, Subd. 4. <br /> <br />Plan Evaluation <br /> <br />Chapter 13, Zoning Regulations Review <br /> <br />1. District Provisions (R-1, Single Family Residential Zoning District) – Section 1320.06 <br /> <br />Lot Size and Dimensions <br />The Subject Property has a lot area of 27,098 square feet. Section 1320 – District Provisions of <br />the Zoning Code requires a minimum lot size of 14,000 square feet per single-family dwelling <br />unit. <br /> <br />Structure Setbacks <br />In the R-1 District, the minimum front and rear setback requirements are 40 feet and 30 feet, <br />respectively. The Shoreland regulations require a 75 foot setback from the Ordinary High Water <br />(OHW) Level of Round Lake. The minimum side yard setback is 10 feet. The Subject Property is <br />a legal non-conforming lot, as the current structure is located approximately 25 feet from the front <br />yard property line. <br /> <br />The proposed single-family dwelling would be setback 28 feet and 11 inches from the front yard <br />property line.
