ARDEN HILLS CITY COUNCIL WORK SESSION – JANUARY 17, 2023 9 <br /> <br />Councilmember Holden asked if they approved something would the home occupation stay with <br />the property. <br /> <br />Community Development Director Jagoe said that was correct. A conditional use permit would <br />run with the property. The permit could have conditions so that any future user would have to <br />have the same occupation that was approved. <br /> <br />Councilmember Holden said she could see someone moving into the property and selling auto <br />parts or anything else. <br /> <br />Community Development Director Jagoe said rewriting the ordinance could allow for a <br />spectrum of uses, so the language may need to be restrictive or provide some prohibited uses. <br /> <br />Councilmember Holden asked if they could they do a Conditional Use Permit without changing <br />the ordinance? <br /> <br />Community Development Director Jagoe said they could, if the business was conducted within <br />the dwelling, in a house or attached garage. Current code doesn’t allow for an occupation in a <br />detached building or exterior of the dwelling. <br /> <br />Councilmember Fabel said he would be delighted to have a business like this in his <br />neighborhood. He felt if there was something in the ordinance that was stopping it from <br />happening then they were being too rigid. He wondered what they would have to do to the <br />ordinance to make it possible to grant a variance for this business. <br /> <br />Community Development Director Jagoe thought they would need to change something in the <br />ordinance language that would allow a pathway to seek a Conditional Use Permit, they wouldn’t <br />be able to approve a variance now because the City cannot issue a variance for a use. <br /> <br />Councilmember Fabel said he would like to see that happen. <br /> <br />Community Development Director Jagoe said they would need to issue a Conditional Use <br />Permit and make a text amendment to the Class II with wording geared toward what they would <br />be permitting for this use. <br /> <br />Mayor Grant asked what kind of plants would be grown. <br /> <br />Ms. Seeman said it would be native plants such as flowers, sedges, and grasses. <br /> <br />Councilmember Monson agreed with Councilmember Fabel’s comments, she thought it was <br />important that they create a pathway for people to start small businesses with the right restrictions <br />and let people use their property the way they need to. <br /> <br />Councilmember Holden asked if in the CUP there would be a provision that it has to be kept up? <br /> <br />Community Development Director Jagoe said they could limit the hours of operation, number <br />of customers at a time, or other conditions that any new property owner would have to operate <br />under.
