Indemnification <br />Rainbow Treecare shall indemnify and hold harmless the City and its employees, and its <br />residents and property owners from and against all claims, damages, losses and expenses <br />including attorney's fees, arising out of or resulting from the performance of the work, provided <br />that any such claim, damage, loss or expense is: <br />(a) Attributable to bodily injury, sickness, disease or death, or to injury to, or destruction <br />of tangible property including the loss of use resulting there from, and <br />(b) Caused in whole or in part by any negligent or wrongful act or omission of the <br />Contractor, any subcontractor, anyone directly or indirectly employed by any of them <br />for whose acts any of them may be liable. <br />The Project Team <br />Contract Supervisor: Ryan Spencer, ISA Certified Arborist MN-4926A, will act as the Contract <br />Supervisor for this Project. Mr. Spencer, Rainbow Treecare's Municipal Consulting Arborist, has <br />a bachelor's degree in Environmental Sciences, Policy, and Management from the University of <br />Minnesota and brings five years of arboriculture and client service experience. As a dedicated <br />full-time employee focused on municipal and governmental forestry, Mr. Spencer is available to <br />quickly respond to any issues that might arise throughout the contract period. <br />Field Inspectors: Private property tree inspections will be primarily performed by Matt Nielsen, <br />ISA Certified Arborist. <br />Technicians: All treatment technicians for this Project will be drawn from the production staff <br />at RTC and will serve the citizens of Arden Hills with a commitment to the highest level of <br />customer service during the protection of trees located within the City. <br />Equipment and Treatment Specifications <br />Upon request, Rainbow Treecare will demonstrate proficiency with the injection equipment <br />and knowledge of the products used to prevent EAB. <br />Safety Standards: Contractor will use work methods, safety procedures and personal protective <br />equipment conforming to all ANSI and OSHA standards in performing the work under this <br />contract and will supply any Material Safety Data Sheets (MSDS) to the City upon request. <br />Formulation Rates: It is the responsibility of Contractor to follow all insecticide instructions. <br />Any alterations in the formulations or equipment must be approved in advance by the city <br />
