<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />... <br /> <br />" <br /> <br />.; <br /> <br />WHEREAS, said Commission now solicits the approval by <br /> <br />the Vi Ilage Counci I of the Vi Ilage of Arden Hi lis of its <br /> <br />proposal to acquire and develop the tracts of land which <br /> <br />comprise the 191 acre Schmidt Park Supplement and Drainage <br /> <br />Corri dor, <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Councl I of the <br />Vi I lage of Arden HI lis that the proposal of the Ramsey County <br /> <br />Parks and Open Space Commission to acquire and develop the <br /> <br />tracts of land which comprise the 191 acre Schmidt Park <br />Supplement and Drainage Corridor be and it hereby Is approved, <br /> <br />subject to the following conditions and limitations: <br /> <br />I. <br /> <br />That the Commission adhere to and abide by <br />the official policy guidelines adopted by <br />it on October 30, 1972 In File No. 12-B, <br />Resolution No. 1-10, as modified or amended <br />by It In Its Resolution No. 1-16 (File No. 12l, <br />adopted on December 18, 1972, and In particular <br />the eight guidelines or assurances set forth <br />in said Resolution No. 1-16; <br /> <br />2. <br /> <br />That the Counci I of the Village of Arden HI lis <br />retain the irrevocable right to withdraw <br />approval as to any tract(sl of land within <br />the Corridor for the acquisition of which the <br />Commission is offering compensation which the <br />Council considers Inadequate; <br /> <br />3. <br /> <br />That the Commission obtain the approval of <br />Councl I of the Vi Ilage of Arden Hills be- <br />fore al lowing the operation and use of motor- <br />ized vehicles within the boundaries of the <br />Corridor; and <br /> <br />4. <br /> <br />That the Commission acquire an easement over <br />and across, rather than the fee title to, those <br />tracts of land which are designated In the <br />proposal to provide access to Lake Johanna and <br />legally described as fol lows: <br /> <br />AI I that part of lot 5, Block I, Wecks <br />Addition, that part of the West 769.13 <br />feet of Government Lot I, that part of <br />the vacated portion of Johanna Boulevard, <br />and that part of lot I, of Hackney Park <br />Plat 2, lying Southerly of the existing <br />and traveled Boulevard and Southwesterly <br />of a line commencing at the Intersection <br />of the East Ii ne of sa i d pa rt of Gove rn- <br />ment Lot I and the Southerly line of said <br />boulevard; thence South on said East line <br />55.26 feet; thence Southeast at an angle <br /> <br />-2- <br />
