[f-;;t f <br /> <br />--. <br /> <br />RESOLUTION DETERMINING THAT AN ENVIRONMENTAL <br />IMPACT STUDY IS UNNECESSARY IN CONNECTION WITH <br />CONSTRUCTION AND INSTALLATION OF ROADWAY AND <br />UTILITIES FROM SOUTHERLY RIGHT-OF..,WAY LINE OF <br />PROPOSED NURSERY HILL COURT TO NORTHERLY <br />RIGHT-OF-WAY LINE OF AMBLE ROAD AS PROPOSED IN <br />THE KARTH LAKE WEST IMl'ROVEMENT <br /> <br />WHEREAS, the Honorable Sidney P. Abramson, Judge of Ramsey <br />County District Court, by Findings of Fact, Conclusions of Law, <br />and Order, dated June 25, 1979 ordered the City of Arden Hills to <br />determine whether an environmental impact study under Section <br />l16D.04 of Minnesota Statutes, as amended, is necessary for the <br />construction of the access route from the southerly right-of-way <br />line of proposed Nursery Hill Court (in the proposed subdivision <br />"Karth Lake West") to the northerly right-of-way line of existing <br />Amble Road, a 60' x 132' portion of which crosses undeveloped <br />property owned by Mr. and Mrs. Charles O. Amble, and the taking <br />of which was deemed necessary and authorized by law in said Order <br />of Judge Abramson, and <br /> <br />WHEREAS, Section l16D.04, Subd. 1, provides in pertinent <br />part as follows-- <br /> <br />"Where there is a potential for significant environ- <br />mental effects resulting from any major governmental <br />action . . . such action shall be preceded by a <br />detailed statement prepared by the responsible <br />agency . . . on: (al the environmental impact of <br />the proposed action. . .", and <br /> <br />WHEREAS, said proposed access roadway will be a "local <br />street" as that term is defined in Section 22-3 of the Arden Hills <br />Code, and its construction in no manner constitutes a "major <br />governmental action" nor has the potential for significant <br />environmental effects, and <br /> <br />-e <br /> <br />WHEREAS, Section l16D.04, Subd. 2, authorizes the Minnesota <br />Environmental Quality Board to promulgate rules and regulations <br />setting forth categories and guidelines as to those instances in <br />which environmental impact statements are required to be prepared <br />for new and existing actions, and <br /> <br />WHEREAS, the City's proposed action in constructing said <br />access roadway and installing utilities therein falls nowhere <br />near any of the mandatory categories for the preparation of <br />environmental assessment worksheets and environmental impact state- <br />ments as those categories are set forth in the rules and regula- <br />tions promulgated by the Minnesota Environmental Quality Board, <br />
