<br />ARDEN HILLS REGULAR CITY COUNCIL MEETING MINUTES <br />MAY 28, 2002 <br /> <br />9 <br /> <br />. <br /> <br />He stated the Fire Department had indicated they were comfortable with the <br />location of the hydrant. He indicated he would not object to a condition being <br />added if the lot \vas developed, there would not be a building pennit issued until <br />the drainage issues had been addressed. He stated Mr. Goserud had as good of an <br />argument as any other resident in the City with respect to the issuance of a <br />variance, He indicated while it might not be the best solution, it was a reasonable <br />one. He inquired about the Park Dedication Fee and how this was going to be <br />determined. He urged Council to base the Park Dedication Fee on an independent <br />appraisal. <br /> <br />Council Member Aplikowski stated it was not Mr. Goserud's property that had a <br />drainage issue, but the adjoining properties, and she did not see that developing <br />this property would affect those drainage issues and may, in fact, help the <br />neighbors' drainage issues, <br /> <br />Mayor Probst stated the motion needed to indicate the approval was based on the <br />findings and conditions as outlined in staffs report. <br /> <br />. Council Member Larson requested the following friendly amendment: "Taking <br />into consideration the referenced recommendations and the conditions that were <br />outlined in staffs report". Altering condition number one to read: "The building <br />permit will not be granted if satisfactory drainage cannot be provided." Condition <br />number five to be inserted after the dedication fee, "the payment of the appropriate <br />park dedication fee is based on an independent appraisal prior to final platting". <br /> <br />Council Member Aplikowski and Council Member Grant accepted the friendly <br />amendment. <br /> <br />Motion carried (3-2) (Council Member Rem and Mayor Probst), <br /> <br />Mayor Probst requested Items D and E be addressed at the same time. <br /> <br />D.
