He noted the cul-de-sac has been redefined as a tear drop shape. <br /> <br />Mr. Fritsinger indicated many of the drainage issues have been addressed, but a number are still <br />being reviewed. The applicant has relocated the detached garage and will use it as a utility garage. <br /> <br />Mr. Fritsinger indicated landscaping has been redefined with 70 trees to be planted. <br /> <br />Mr. Fritsinger noted there should be an amendment to the Comprehensive Plan, although this <br />proposal does meet the requirements of the Zoning Ordinance. The amendment is for <br />clarification purposes and is not required for the project to be approved. <br /> <br />Mr. Fritsinger indicated receiving letters from neighbors in opposition to the project, most concur <br />to leave as an open space. <br /> <br />Councilmember Hicks indicated he did not disagree with the project per say, but believes the <br />increase in traffic to County Road E would force him to vote against the development. The <br />closing of the north bound exit on Snelling Avenue by the County, causes traffic issues. <br /> <br />Councilmember Aplikowski indicated she is trying to keep an open mind regarding the <br />development and she lives near the area. <br /> <br />Councilmember Keirn inquired if there were common areas or just green space. Mr. Dan Ogren, <br />the applicant indicated it would be green space, no playgrounds or such. <br /> <br />Acting Mayor Malone inquired if action was needed. Mr. Fritsinger indicated no, but any <br />comments would be welcome, this would be before the Planning Commi",.ion on March 1, 1995. <br /> <br />PLANNING CASE 95-7. MCGUIRE VARIANCE <br /> <br />City Administrator Fritsinger indicated the applicant requested variances to the front yard and <br />lakeshore setback requirements. A variance to Section IX, nonconforming uses was also <br />requested. <br /> <br />Mr. Fritsinger noted the unusual circumstances surrounding this request, the applicant's home <br />had been damaged in a fire and they wish now to demolish and rebuild. The City building <br />official estimated that the value of the damage did not exceed 50% of the fair market value, but <br />the applicant indicates it will cost the same to repair as compared to rebuild. <br /> <br />Mr. Fritsinger indicated the home was built in 1954 and the garage in 1968. He state a Lakeshore <br />Setback Variance was approved as part of Planning Case #80-17 for the construction of a deck. <br />
