<br />I <br />I. <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I- <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />Ie <br />I <br /> <br />,ARDEN HILLS CITY COUNCIL - JULY 31..J 995 <br /> <br />5 <br /> <br />Mayor Probst indicated there are several options tl1e Council could choose: 1) approve assessment <br />roll with no change; 2) correct assessment witl1 comer lot formula; or 3) table tl1e item. <br /> <br />Councilmember Aplikowski indicated she felt uncomfortable witl1 making a decision at this point. <br /> <br />MOTION: <br /> <br />Aplikowski moved and Keirn seconded a motion to table the adoption of Resolution <br />95-57 until August 14, 1995 and direct staff to review options fortl1e assessment roll. <br /> <br />Councilmember Keirn inquired as to tl1e information Council wishes to have staff obtain. <br />CounciImember Aplikowski indicated she wished for staff to review configurations of formulas <br />available and establish what may be the best way in which to assess this unique development. <br />CounciImember Aplikowski indicated it is not just the money issue, but tl1ere will be a precedent <br />established. <br /> <br />Motion carried (2-1, witl1 Mayor Probst opposed). <br /> <br />Mayor Probst indicated this would be a continued item and tl1ere will be no additional publication <br />of the Publie Hearing. <br /> <br />Mr. Getty inquired as to when tl1e 30 day period for appeals would begin. Mr. Filla indicated the <br />written objection would need to be presented to the City prior to tl1e close of the Public Hearing and <br />tl1en the resident would have 30 days from tl1e time of the adoption of tl1e Assessment Roll by tl1e <br />City Council. <br /> <br />Mr. Harkness inquired if the letter sent to tl1e City would be a formal objection. Mr. Fritsinger <br />indicated typically each homeowner would need to formally object. <br /> <br />Mr. Filla after reviewing the letter of July 11, 1995, indicated this would not be a formal objection. <br /> <br />Mr. Porter inquired if there is a way to preserve the options of appeals by continuing the Public <br />Hearing. Mr. Filla indicated iftl1e City Council made a motion, this would be possible. <br /> <br />MOTION: <br /> <br />Ap1ikowski moved and Keirn seconded a motion to reopen the Public Hearing for <br />1995 Street Maintenance Improvement Project. Motion carried unanimously (3-0). <br /> <br />Mr. Fritsinger asked if the letters of objection need to be filed before the close oftl1e Public Hearing. <br />Mr. Filla indicated that was correct and any objections must be made in writing to tl1e City prior to <br />tl1e close of tl1e Public Hearing. <br /> <br />MOTION: <br /> <br />Keirn moved and Aplikowski seconded a motion to continue the Public Hearing on <br />1995 Street Maintenance Improvement Project to the August 14, 1995 Regular <br />Council Meeting at 8:00 p.m. The motion carried unanimously (3-0). <br />
