He noted that the residents realize this contractor is not responsible for all <br />the problems, but there are many subcontractors and outside utility companies that have caused <br />problems. <br /> <br />Councilmember Hicks agreed that to hold the line would be prudent and utilize whatever mechanism <br />is available to address the outstanding issues. <br /> <br />City Attorney Filla, in response to comments regarding lawsuits, these comments could also be <br />forwarded to the contractor, and noted that money would be retained to cover the City's legal costs. <br /> <br />Mayor Probst noted the payment can be sent with a message that if the issues are not resolved the <br />retainage on the next payment would be increased. <br /> <br />MOTION: Hicks moved and Malone seconded a motion to authorize payment to Midwest <br />Asphalt, Inc. in the amount of$338,738 and direct the City Administrator to send a <br />letter indicating the Arden Hills City Council expects all open matters and potential <br />concerns to be addressed before payment number two. Motion carried unanimously <br />(5-0). <br /> <br />TCAAP <br /> <br />City Administrator Fritsinger indicated a public informational meeting was held in July. He noted <br />the next Public Meeting will be August 24, 1995 at the Holiday Inn. <br /> <br />Mr. Fritsinger indicated the TCAAP Task Force has presented two plans to the public and will be <br />presenting a final plan for any comments. He noted once the Task Force has received all comments <br />and input, they will be presenting this final plan to the City Council. <br /> <br />Mr. Fritsinger noted that Congressman Vento's Committee will be meeting two more times in <br />September and he will be presenting the Arden Hills plan. <br /> <br />ADMlNISTRATOR COMMENTS <br /> <br />Mr. Fritsinger commented on a few items: <br /> <br />Boulevard trees: <br /> <br />Mr. Fritsinger indicated he had received a letter requesting the planting of boulevard trees <br />by the City. He noted he was not familiar with any City policy for the planting of boulevard <br />trees, and was providing this for information to the Council for direction. <br />
