Staff recommends that this be paid in a lump sum before any building permits are <br /> issued. <br /> . Mr. Craig Wilson, 1677 West County Road F, recommended the Council defer action on the <br /> park dedication fee for the lot on the corner of E2 and Old Snelling since a fair market value <br /> could not have been established for the property. The fact that the Purchase Agreement between <br /> . Mr. Ogren and Bethel was not an arms length arrangement and the property was not sold on the <br /> open market supports this point. Mr. Wilson further recommended the Council require an <br /> appraisal, because the sale of the land had not yet been recorded with Ramsey County. <br /> . Mr. Dan Ogren, 466 Old Farm Road, applicant in the case, indicated the sale of the land and <br /> .- purchase price had been recorded at Ramsey County Court. <br /> Councilmember Keirn indicated the City Attorney has reviewed the purchase agreement and felt <br /> the agreement was appropriate and in order. <br /> . MOTION: Keirn moved and Malone seconded a motion to approve park dedication <br /> . requirement of$8,012.52 from the Townhomes of Lake Valentine in lieu ofland. <br /> The motion carried nnAnimously (4-0). <br /> . Councilmember Malone indicated the determination of the park dedication fee is similar to <br /> previously accepted park dedication fees. He believed the cost of an appraisal would not benefit <br /> the City nor the applicant. <br /> . Councilmember Aplikowski indicated the purchase price of the property is known and the fee is <br /> established based on this price, and felt this to be appropriate. <br /> . Mayor Probst indicated City Attorney Filla reviewed the issue and felt all the standards had been <br /> met. Mayor Probst believed there was no reason to require an appraisal, <br /> .
