Page 1 of 4 <br /> <br />DATE: December 11, 2023 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> <br />FROM: Dave Perrault, City Administrator <br /> <br />SUBJECT: Earned Sick and Safe Time Personnel Policy Update <br /> <br />Budgeted Amount: Estimated Amount: Funding Source: <br />N/A N/A N/A <br /> <br />Council Should Consider <br /> <br />Motions to approve, table, or deny the following: <br /> <br />• Addition of Earned Sick and Safe Time language to the Personnel Policy. <br /> <br />Background <br /> <br />The State of Minnesota recently passed a new rule requiring employers to provide a base level of <br />Earned Sick and Safe Time (ESST) to employees; the minimum accrual amount is one hour per <br />every thirty hours worked. For permanent employees, the City’s PTO program is already more <br />generous than the State’s requirement; however, we will also need to offer this benefit to <br />seasonal/temporary employees. Staff is proposing that we add the required language regarding <br />ESST to our Personnel Policy effective January 1, 2024. This will bring us into compliance with <br />State requirements, and following the upcoming compensation study (still to be approved by <br />Council), we will also ask the consultant to provide any recommendations regarding ESST for <br />beyond 2024. The language to be added to the Personnel Policy can be found below (this <br />language is based off LMC’s model policies regarding ESST): <br /> <br />Earned Safe and Sick Time (ESST) <br />Effective January 1, 2024, Minnesota’s earned safe and sick time (ESST) law requires employers <br />to provide paid leave to employees who work in the state. All permanent full-time and part-time <br />employees who currently earn PTO will now earn combination PTO/ESST hours. Non-PTO- <br />earning employees will accrue ESST at the rate of one hour per every thirty hours worked not to <br />exceed forty-eight hours in a year. Any provisions regarding ESST in this policy shall also be <br />applicable to PTO unless otherwise noted or required by State Statue. <br /> <br />CONSENT ITEM – 8D <br /> <br /> MEMORANDUM <br />
