May 31, 1988 <br />Page 2 <br /> <br />ORD. #258 (Cont'd) Lynden advised that the proposed ordinance is a draft of <br />an ordinance on file with the League of Minnesota Cities; <br />it is necessary for Council to designate certain time limits. and a person or <br />persons responsible for receiving and reviewing violations. An impartial panel of . <br />three residents must be appointed to serve as the hearing board. It was his <br />recommendation thst the time limit for notice of water shut off and an <br />opportunity for a hearing should be 30 days. Lynden further recommended the Clerk <br />Administrator be designated to receive and review violations, appoint the panel <br />of three impartial residents to serve on the hearing board and determine <br />satisfactory resolution of the delinquent accounts. <br /> <br />The Attorney also noted a time limit should be specified for setting the date of <br />the hearing after the appointment of the hearing board. <br /> <br />After discussion. Council concurred to insert language which stated the hearing <br />should be held with "reasonable promptness. but no less than two weeks" after the <br />appointment of the three members of the panel. <br /> <br />Attorney Lynden advised that language should be inserted which specified the <br />violators be notified by certified mail of the date. time and place of the <br />hearing. <br /> <br />After discussion. Council concurred with the recommendations of the Attorney for <br />the time limits for notice of water shut off and setting the date of hearing. <br />Council also agreed that the Clerk Administrator should be designated to review <br />and receive the violations and appoint the hearing panel to determine <br />satisfactory resolution of the delinquent accounts. <br /> <br />. <br /> <br />Council concurred that the language in Section 28-19 (a) (3) be changed to read: <br />"....the premises served by the connection are unpsid for a period of two <br />consecutive calendar year quarters.". rather than five. <br /> <br />Hansen moved. seconded by Peck, that Council suspend the <br />rules and dispense with the two readings of Ordinance No. 258. Motion carried <br />unanimously. (4-0) <br /> <br />Peck moved, seconded by Hansen. that Council adopt <br />Ordinance No. 258. AN ORDINANCE AMENDING SECTION 28-19 OF ARDEN HILLS CODE. WHICH <br />PERTAINS TO DISCONTINUANCE OF WATER SERVICE FOR VIOLATIONS, BY ADDING NEW <br />PROVISION REQUIRING NOTICE AND PRE-DISCONTINUANCE HEARING. with changes as <br />discussed and approved by Council. Motion carried unanimously. (4-0) <br /> <br />REPORT OF ENGINEER <br /> <br />WATER TOWER CONTROLS <br /> <br />Council was referred to a memorandum from Engineer Donald <br />Lund of SEH. regarding his intent to discuss the water <br />tower at the Council meeting this evening. 4It <br /> <br />Engineers Donald Lund. Barry Peters and Will Liebenow. from SEH. were present. <br /> <br />Lund explained how the Roseville/Arden Hills water system functions. and reviewed <br />the demands which are placed on the system based on residential. commercial. and <br />industrial use. fire protection and times of the day. as well as weather <br />conditions. He reviewed the hydraulic pressure grade line and how it relates to <br />changes in pressure, and the operation of the pump stations. <br /> <br />Lund advised Council that the new' elevated water tank in Arden Hills was <br />constructed at the same height as the Roseville tank. He explained that with the <br />use of an altitude valve. which closes when the Roseville tank reaches a certain <br />level. Arden Hills water tank would fill to capacity. Lund also advised that the <br />water level sensing instruments have not been installed in the new water tank. <br />therefore. it has not yet been determined how the tank operates. <br /> <br />Lund stated that if Arden Hills determines that the new water tower should be at <br />full capacity at all times. an altitude valve would have to be installed and the <br />controls for the Roseville pumps should be installed in the new Arden Hills tank. <br /> <br />. <br />
