DEVELOPHKNT AGREEMENT <br /> THIS AGREEMENT, Made this ___ day of . 19 -' by and <br /> between the CITY OF ARDEN HILLS. a statutory city under the laws <br /> of the State of Minnesota (the "CITY") and Robert Raddatz (the <br /> "OWNER"). <br /> WIT N E'S SET H <br /> WHEREAS, the Owner has made application to the City Council <br /> for extension of watermain on public right-of-way to serve his <br /> property described as <br /> Lot 2 Block 1 Carlson Addition <br /> which is located within the corporate limits of the City in the <br /> County of Ramsey and State of Minnesota, and shall hereinafter be <br /> referred to as the "Property" and <br /> . WHEREAS. the City Council has granted final approval of the <br /> request for watermain extension subject to the Owner's execution <br /> and delivery of this Agreement and all related documents, <br /> WHEREAS, the watermain extension when completed, will be <br /> City owned and maintained. <br /> NOW, THEREFORE, in consideration of the mutual covenants and <br /> promises herein set forth, the' City and the Owner hereby agree as <br /> follows: <br /> l. Improvements Requested - The improvements to be undertaken <br /> and completed in connection with the Property shall be the <br /> obligation of the Owner. These improvements shall <br /> hereinafter be referred to as the "Owner Improvements" or <br /> "Project" . They are set forth on Exhibit "A" attached <br /> hereto and made a part hereof. <br /> 2. Owner Warranty - Owner hereby warrants to the City, as an <br /> inducement to the City's entering into this Agreement, that <br /> Owner has sufficient ownership interest in the Property to <br /> . make the representations and undertake the obligations set <br /> forth herein. <br /> - 1 - <br />
