<br /> . <br /> . 3. Owner Improvements <br /> a. Obligation to Construct and Install Owner Improvements. <br /> Owner shall construct and install the Owner <br /> Improvements in accordance with the terms and <br /> conditions set forth in this Section and in Exhibit "A" <br /> at Owner's expense and not at the expense of the City. <br /> b. Construction Plans ahd Specifications and Approval <br /> Thereof. The City has authorized, at the Owner's <br /> expense, the services of the City's Engineer to prepare <br /> detailed plans and specifications for Owner <br /> Improvements. The City's Engineer is an agent for the <br /> City and not the Owner. Such plans and specifications <br /> shall be submitted to and be approved by the City <br /> Council prior to commencement of construction of any <br /> Owner Improvements. <br /> . c. Engineering Services ( Construction) . The City's <br /> Engineer shall provide all necessary staking and shall <br /> provide a Resident Project Representative. The cost of <br /> such services furnished by the City's Engineer shall be <br /> paid to the City by the Owner. <br /> d. Payment for .City's Engineering Services. The Owner <br /> shall pay the City for costs incurred by the City's <br /> Engineer in rendering services to Owner in connection <br /> with the Owner Improvements. Prior to commencing work, <br /> the Owner shall deposit with the City of Arden Hills <br /> cash, a bond or letter of credit in the amount of <br /> $4,000 to guarantee payment of services rendered. The <br /> substance, form and execution of any such bond or <br /> letter of credit shall e subject to approval of the <br /> City Attorney. <br /> . e. Acquisition of All Necessary Permits. The Owner shall <br /> be responsible for acquiring all necessary permits from <br /> - 2 - <br />
