<br /> . <br /> . all governmental agencies which have jurisdiction over <br /> the Project and hereby agrees that in the event the <br /> City has to assist Owner in obtaining any permits that <br /> Owner shall reimburse the City for all legal and <br /> engineering fees and costs and disbursements incurred <br /> by the City in making appearances and appeals before <br /> the boards of commissions of any such governmental <br /> agencies. <br /> f. Construction Performance Standards. The construction, <br /> installation, materials and equipment used and employed <br /> in connection with the Owner Improvements shall be in <br /> accordance with the plans and specifications prepared <br /> by the City Engineer. The Owner shall cause the <br /> contractora who are to make the Owner Improvements to <br /> furnish the City Engineer with a schedule of proposed <br /> . operations at least five (5) days prior to commencement <br /> of the work. . <br /> g. Approval. All of the Owner Improvements work shall be <br /> under and subject to the approval of the City and any <br /> other governmental agency having jurisdiction thereof. <br /> h. Easements. The Owner shall make available to the City, <br /> at no cost to the City, all permanent or temporary <br /> easements necessary for the installation of the OWner <br /> Improvements as determined by the City Engineer and the <br /> City Attorney. All such easements required by the City <br /> shall be in writing, in recordable form, and on the <br /> standard easement form of the City or on such other <br /> terms and conditions aa the City shall determine. <br /> Owner may require the acquisition by the City of <br /> . easements on property owned by others. If Owner does, <br /> any cost of such easement acquisition shall be paid by <br /> Owner. <br /> - 3 - <br />
