Lindey's Trian~le: Rob Plunkett w~ll be present to answer any questions you may have. As discussed earlier, Judge Fleming has ruled that the area is being used for public purpose, so one question Rob may present is whether the Council wants to pursue the condemnation proceedings. 5. Scherer Brothers: This rezoning was approved by Council at their meeting of May 11; the Ordinance is presented in final form. 6. C. G. Rein: Again, the rezoning was approved by the Council on May 11; and the Ordinance is presented for Council approval. 7. Snowmobile Ordinance: Mr. Lynden has forwarded the final draft of the Snowmobile Ordinance; therefore, it is enclosed for your consideration and action. . 8. Charitable Gamb~in~: Jim Lj-nden will be present to d~scuss the proposed ordinance. Although I have not received the Ordinance as of this writing, I believe Mr. Lynden will be determining a reasonable method for limiting and phasing out the number of occasions andlor the number of organizations allowed within one facility. He has had an opportunity to review new legislation passed in the last session. As Mr. Lynden was working with minimal direction, the Council may want to review the Ordinance carefully to determine that the desired results have been met. A copy of the new legislation is enclosed for your information. 9. Case No. 87-17: The Planning Commission has recommended approval of a 5' variance for enclosure of a porch of the residence located at 1136 Hunter's Court. The Council, if they approve the variance, may wish to incorporate in their motion the Commission's rationale for approval. 10. Case No. 87-18: The Commission recommended approval of the site plan review and variance, with reorientation of the parking lot, and, issuance of a conditional building permit for the life of the structure, or ten years (page 3 of Planning Commission minutes). If the Council determines they wish to approve this, you may want to make your approval contingent upon approval of the variance by the Board of Appeals. . 11. Case No. 87-19: The Planning Commission recommended approval of the daycare, with several contingencies (page 5 of Planning Commission minutes). The Council may wish to address signage, as the proposal includes installation of a pylon sign, as well as a brick base sign.
