All of the ,.' provisions of the Arden Hills City Code including particularly those set forth in Chapter 22 thereof are incorporated herein by reference, and tpe Developer's violation of any of the provisions of the Code shall be considered to be a breach of this Agreement, 2. Improvements Necessary. Section 22-10 of the Arden Hills Code specifies what improvements must be made by or on behalf of the Developer in connection with the subdivision of a tract of land, Section 22-10(b) declares as a policy of the City that the improve~ents in connection with the plat be installed as soon as practicable after final approval of the plat by the City Council, Accordingly, time is of the essence subject, however, . to climatic and seasonal conditions, Certain of the improvements to be undertaken and completed in connection with the Subdi~ision shall be the obligation of the Developer and certain of them shall be the obligation of the City. Those improvements to be made by the Developer shall f hereinafter be referred to as wDeve10per or Developer's Improve- ments. and those to be made by the City shall hereinafter be 1 referred to as "City Improvements., The Developer Improvements '1 are set forth on Exhibit "C. attached hereto and made a part 'J hereof. The City Improvements are set forth on Exhibit "D. also I attached hereto and made a part hereof. Both the Developer and . City Improvements shall hereinafter be called the "Project". The Developer wishes to reserve judgment as to whether or i . not it desires the City to install the City Improvements.
