All of the <br /> ,.' <br /> provisions of the Arden Hills City Code including particularly <br /> those set forth in Chapter 22 thereof are incorporated herein by <br /> reference, and tpe Developer's violation of any of the provisions <br /> of the Code shall be considered to be a breach of this Agreement, <br /> 2. Improvements Necessary. Section 22-10 of the Arden <br /> Hills Code specifies what improvements must be made by or on <br /> behalf of the Developer in connection with the subdivision of a <br /> tract of land, Section 22-10(b) declares as a policy of the City <br /> that the improve~ents in connection with the plat be installed as <br /> soon as practicable after final approval of the plat by the City <br /> Council, Accordingly, time is of the essence subject, however, <br /> . to climatic and seasonal conditions, <br /> Certain of the improvements to be undertaken and completed <br /> in connection with the Subdi~ision shall be the obligation of the <br /> Developer and certain of them shall be the obligation of the <br /> City. Those improvements to be made by the Developer shall <br /> f <br /> hereinafter be referred to as wDeve10per or Developer's Improve- <br /> ments. and those to be made by the City shall hereinafter be <br /> 1 <br /> referred to as "City Improvements., The Developer Improvements <br /> '1 <br /> are set forth on Exhibit "C. attached hereto and made a part <br /> 'J <br /> hereof. The City Improvements are set forth on Exhibit "D. also <br /> I <br /> attached hereto and made a part hereof.
