<br /> . <br /> . ments, then it shall install the City Improvements prior to being <br /> allo....ed occupancy of the building to be constructed on Lot 2, <br /> Block 1 of the Subdivision by the City, In the event that the <br /> Developer is to install the City Improvements, then Developer <br /> shall be obligated to reimburse the City for all reasonable <br /> expenses incurred by the City arising out of the Project <br /> (including but not limited to expenses incurred in the prepara- <br /> tion of the Feasibility Report) to the date of the City's receipt <br /> of Developer's notice of its intention to do the City Improve- <br /> ments itself rather than to have the City do them and all of <br /> Developer's requirements as to the Developer Improvements set <br /> forth in the next Section hereof shall be applicable to its <br /> . installation of the City Improvements. Accordingly, if the <br /> Developer has opted to do the entire Project, all of the provi- <br /> sions of the next Section hereof shall be deemed to create <br /> obligations upon Developer in its performance of the Project. <br /> 3. Developer's [Project] Improvements. <br /> (al Obligation to Construct and Install <br /> Developer's [Project] Improvements. <br /> Developer shall construct and install the <br /> Developer [Project] Improvements in <br /> accordance with the terms and conditions <br /> set forth in this Section at Developer's <br /> expense and not at the expense of the <br /> City. <br /> (bl Construction Plans and Approval Thereof. <br /> Developer shall engage, at Developer's <br /> expense, a Minnesota registered civil <br /> engineer and/or land surveyor to prepare <br /> detailed plans and specifications for the <br /> complete installation of all Developer's <br /> . [Project] Improvements in accordance with <br /> City standards, including designation and <br /> description of all necessary temporary and <br /> permanent easements if any are required, <br /> - . <br /> , - <br /> ...... -..-..-.-.--.... <br />
