. . ments, then it shall install the City Improvements prior to being allo....ed occupancy of the building to be constructed on Lot 2, Block 1 of the Subdivision by the City, In the event that the Developer is to install the City Improvements, then Developer shall be obligated to reimburse the City for all reasonable expenses incurred by the City arising out of the Project (including but not limited to expenses incurred in the prepara- tion of the Feasibility Report) to the date of the City's receipt of Developer's notice of its intention to do the City Improve- ments itself rather than to have the City do them and all of Developer's requirements as to the Developer Improvements set forth in the next Section hereof shall be applicable to its . installation of the City Improvements. Accordingly, if the Developer has opted to do the entire Project, all of the provi- sions of the next Section hereof shall be deemed to create obligations upon Developer in its performance of the Project. 3. Developer's [Project] Improvements. (al Obligation to Construct and Install Developer's [Project] Improvements. Developer shall construct and install the Developer [Project] Improvements in accordance with the terms and conditions set forth in this Section at Developer's expense and not at the expense of the City. (bl Construction Plans and Approval Thereof. Developer shall engage, at Developer's expense, a Minnesota registered civil engineer and/or land surveyor to prepare detailed plans and specifications for the complete installation of all Developer's .
