Council members expressed concern <br /> over the conveyance of a lot within the PUD to the U. S. Fish and Wildlife <br /> Servi ce. The primary concern is that the USF&W Service may eventually <br /> want to use the lot for increased public access to Round Lake, or use it <br /> in some other manner contrary to the desires of the City and/or the <br /> residents within the PUD. When the Council approved the PUD and plat, <br /> it was their intention that the homeowners association would retain <br /> ownership of the easement area as permanent open space. <br /> As I discussed with you previously (letter of March 3, 1987), restrictive <br /> covenants which would require that (1) the lot remain as permanent open <br /> space, (2) the land not be used for general public access to the lake, <br /> and (3) the location and design of any access trail be approved by the <br /> City, might protect the City's interests. I have checked with Jim <br /> . Lynden, the City attorney, and it is his opinion that such restrictive <br /> covenants are enforceable against a Federal agency. However, Counc il <br /> members remain concerned about conveyance of the land to a Federal <br /> agency. Because approval of a revised plat is required, the Council <br /> could prohibit the conveyance by refusing to create Lot 23. <br /> 'Regarding the proposed location of the access road, I have two comments. <br /> First, I question the need for a looped trail; a single trail seems <br /> adequate.
