- -..
MEMORANDUM
. --------------------------------------------------------------------------
Date: October 23, 1987
To: Mayor and Council , \ "U
From: Patricia J. Morrison, Clerk Administrator ~l1
ReI Agenda Items, October 26 Council Meeting
--------------------------------------------------------------------------
4. Ordinance No. 251, Exterior Construction
You were presented with Ordinance No. 251, for Introduction by Title,
on September 28. Since then, Larry Squires, our Building Inspector,
has expressed concern, to Jim Lynden and me, relative to Section 6-128
which ties issuance of a Certificate of Occupancy with compliance of
terms as listed in 6-75(b). Larry's general concern is with
enforceability; i.e. , if home construction is started late in the
year, (the Ordinance requires full compliance with terms listed), the
homeowner may desire to occupy the home before some of the terms
(examplel driveway completion and final grading) could be completed.
He would prefer that the Certificate of Occupancy terminology of the
Ordinance be deleted.
This would weaken the enforceability of the Ordinance, however.
. Mr. Lynden will discuss this with you Monday night. Mayor Woodburn
has suggested a major concern for occupancy should be health and
safety factors (water, sewer availability, etc.) and if those concerns
are met, the Certificate of Occupancy could be issued.
5. Ordinance No. 252, Special Event Si~ns
This Ordinance was Introduced by Title at the October 12 meeting (and
passed by a 3 to 1 vote) is being presented for Fin~l Reading.
6. Ordinance No. 253, Code Violation Enforcement
This Ordinance, too, was Introduced by Title at the October 12
meeting, (passed 4-0), and is being presented for Final Reading.
7. Animal Pound Contract
The City had a contract on file, dated 1980. The contract presented
to Council in the packet is in the same format; however, the following
changes are being suggested and are in the proposed contract:
A. Elimination of fees in body of contract, and instead set forth by
Resolution.
B. Allowance of issuance of licenses by Brighton Veterinary Hospital
(1/8) ; and
C. Increase in insurance coverage from $100,000 and $250,000 (#15);
and
The hold harmless clause (#14) is as set forth in the 1980 contract.
. A copy of the contract has been forwarded to Bill Hite and Dr. Hedges
for comment. Mr. Lynden will discuss the contract Monday night.
__. u____.._..______
