Planning Commission Review <br />The Planning Commission reviewed this application at the January 3, 2024 meeting. A <br />recommended condition of approval was added by the Planning Commission to include "The <br />Applicant shall provide a diagram of the off -site parking spaces provided for by the reciprocal <br />easement agreement." The Applicant provided this information after the meeting and it has been <br />included as Attachment M. The Commission voted 6-0 to recommend approval with 21 <br />conditions of Planning Case 23-023. <br />Since the January Planning Commission meeting, the Applicant has made updates to the <br />submitted application, removing requests for flexibility for building materials, building <br />transparency, lighting, fencing, landscaping, and graphic sign illumination. Additionally, the <br />requested flexibility for total freestanding sign area has been decreased following the review of <br />Planning Commission. <br />Additional Review <br />Building Official <br />The Building Official has reviewed the plans and has no additional comments at this time. A <br />Building Permit will be required prior to any construction taking place. <br />Public Works Director/City Engineer <br />The Public Works Director/City Engineer has reviewed the plans and has provided the Applicant <br />with a comment letter (Attachment L) and all comments shall be adopted herein by reference as a <br />condition of approval. <br />Fire Marshal <br />The Fire Marshal is currently reviewing the plans. No additional conditions have been included <br />at this time. <br />Ramsey County <br />Ramsey County has reviewed the plans and offers the following comments: <br />• Programming: Ensure references to Lexington Avenue include the completed <br />construction project from 2023. <br />• Maintenance: New driveway appears to have been placed with the road's construction. <br />Existing new driveway to be utilized for any new entrance improvements to the proposed <br />development. No excavation cuts into the new concrete pavement be considered for the <br />proposed new HDPE storm sewer line. Applicant to submit a proposal to use directional <br />drilling of solid wall HDPE, (SDR 26 or less preferably 17). Manhole to be inside core <br />drilled, interior pipe seal used and outside annual space of drilling mud replaced with <br />stabile material. <br />• Permitting: A ROW Permit will be needed prior to beginning construction to extend curb <br />tie-in into the county Right -of -Way. Stormwater overflow should be connected into the <br />back of the catch basin behind the curb line as it will handle the flow per the stormwater <br />report. Developer should make the changes to the plan as Ramsey County would not <br />approve an excavation permit in this area as it would fall under 5 year moratorium. <br />All Ramsey County comments shall be adopted herein by reference as a condition of approval. <br />Page 15 of 16 <br />
