December 28. 1987 Page 2 KEM MILLING (Cont'd) Lynden reviewed the timetable for the plant to conduct testing, develop alternative solutions for compliance and report to Council with plans for improving the odor emission control equipment before Kay 1. 1988. He noted the agreement also stated the Company and the City ~ would reach agreement as to which proposed solution should be implemented by June I, 1988. and upon reaching such agreement, the Company agrees to implement the solution within three months to bring the plant facilities into compliance with Minnesota Rules. Lynden further advised that he would be discussing this matter with Kem Milling Company Attorney, Mr. Robert Johnson, who was directly involved with drafting the MPCA Rules. in January to discuss any changes. Councilmember Winiecki commented that Jerry Liefert of the MPCA had questioned the testing criteria: it was suggested that testing be conducted when the plant is at full production. She suggested that provision be made in the agreement for the following information to be recorded when testing is done: amount of batch. ~ooking time and temperature. Robert Freed agreed andcommented that such record keeping would be helpful not only to the City in regulating odor emissions. but also would aid the. plant personnel in finding a solution for eliminating odor emissions. Tim Guzek, representing Kem Milling, requested Council continuation of this matter to the next regular Council meeting; he advised his environmental engineer would be arriving in town next week from Dallas, to review the plant equipment and attend the committee meeting scheduled on January 7th. Guzek also noted that . the time extension would allow his attorney time to review the proposed agreement. Mayor Woodburn questioned if the plant engineer would be meeting with the MPCA representatives: he suggested it would be a good opportunity to arrange such a meeting and discuss implementation procedures for compliance with MPCA regulations. Councilmember Sather questioned if the plant is governed by USDA standards: Guzek stated the plant is governed by USDA standards. Dodie Kosticheck, rendering plant committee member. stated it was her opinion the City has not been responsible to residents demands to alleviate the-odor problem: she commented that the City may be relying too heavily on MPCA to solve the problem of odor emissions. Mayor Woodburn disagreed, and advised that this year the City had received more complaints, than in past years; he noted that the City was advised that MPCA standards for testing odor emissions were being met and Council was advised over the years that the test results showed compliance with the standards. e Mary Gilles. 1736 Crystal Avenue. stated that she and her neighbors had been forwarding complaints of the odor emissions over the past several years. Councilmember Winiecki stated that she had also forwarded complaints to the City and the MPCA directly: commented that MPCA had responded to the complaints by stating all that could be done was being done. Council concurred that they would consider granting the two week continuance of this mat ter. to allow Guzek time to confer with the plant environmental engineer and attorney, however, they advised that Guzek should be prepared to address all issues discussed this evening. as it is the intent of the Council to bring this matter to a conclusion at the January 11th regular Council meeting. Moved by Sather, seconded by Peck, that the proposed 1988 agreement with Kem Milling Company be tabled to the next regular Council meeting to be held on Monday, January 11, 1988, at 7:30 p.m.. at the Village Hall. Motion carried. (Sather.
