It <br /> -AR�EN HILLS <br /> CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. 2024-007 <br /> RESOLUTION APPROVING A VARIANCE <br /> AT 1666 OAK AVENUE <br /> WHEREAS, City Staff received a complete land use application for a variance to the front <br /> yard setback on a corner lot from the City Code for the property located at 1666 Oak Avenue and <br /> legally described on Exhibit A attached hereto ("Subject Property"); and <br /> WHEREAS, the Applicant is proposing to construct a covered porch addition on an <br /> existing nonconforming dwelling structure and is seeking flexibility with the required front yard <br /> setback on the Subject Property; and <br /> WHEREAS, the Subject Property is zoned R-1, Single Family Residential District, which <br /> requires a front yard setback of 40 feet on the Subject Property. The Applicant is proposing a front <br /> yard setback of 29.6 feet; and <br /> WHEREAS, a variance may be granted when it is in harmony with the general purposes <br /> and intent of the zoning ordinance if enforcement of a provision in the ordinance would cause the <br /> landowner practical difficulties; and <br /> WHEREAS, pursuant to Minnesota State Statute, the City must act on this request by <br /> January 11, 2024 (60 days), unless the City provides the petitioner with written reasons for an <br /> additional 60-day review period; and <br /> WHEREAS, pursuant to Minnesota State Statute, the City provided the petitioner with <br /> written reasons for an additional 60-day review period, and the City must act on this request by <br /> March 29, 2024; and <br /> WHEREAS, the City Council directed Staff to prepare a Land Use Application Public <br /> Policy Notification to notify all property owners within 500 feet of Subject Property when a request <br /> for the Planning Commission is to occur related to a land use application that does not require a <br /> public hearing; and <br /> WHEREAS, the City's obligation has been met where the Arden Hills Planning <br /> Commission reviewed the application on January 3, 2024. All written comments submitted in <br /> advance of the meeting were presented to the Planning Commission; and <br /> Pagel of 3 <br />
